I have a question about Triad saying it's standard procedure.
Did Ohio have it's ballots sorted for undervotes and overvotes before this recount? Is this the 92,000 spoiled ballots?

I believe Triad could be going on a standard procedure during a recount (for machine adjustments) when your sorting overvotes and undervotes in more than one race at the same time. More spoiled ballots in other races would be spit out causing more sorting.

The thing is those ballots have already been sorted. This would be the 92,000 ballots. Correct me if I'm wrong.

1. And how much $$$ do they charge? Since this isn't regular service
after Ohio bought these machines, they must have some cost associated with doing customization or special requests - Triad is a business (in spite of the cheesey look of their website). So how much did they bill the gov't of OH for? Seems like some of the threads talked about there being no charge in the BOE affidavit. Total BS.

4. I can't find Ohio laws on this, but find procedures on this.
3. Procedure when more than one race is being recounted by machine and the voting system does not allow the sorting of overvotes and undervotes on more than one race at a time:

a. The canvassing board or its representatives shall put each ballot through the tabulating equipment and determine the votes in the affected races.

b. The canvassing board shall produce vote counts for those races involved in the machine recount.

c. Prior to a manual recount being conducted, the supervisor of elections shall change the election parameters and the ballots for the manually recounted race or races shall be put back through the tabulating equipment and overvotes and undervotes for each race shall be sorted separately.

Here is Florida recount procedures.

5. I originally thought of this by reading Ohio law.
And was wondering what exactly they meant by they shall open the compartments of the machines and, without unlocking the machines, shall recanvass the vote cast in them as if a recount were being held.

§ 3506.14. Testing of computer programs, voting machines and tabulating equipment.

(A) Prior to each election, the board of elections shall test and audit the variable codes applicable to that election to verify the accuracy of any computer program that will be used for tallying the ballot cards for each precinct in which an election will be held.

(B) Prior to the start of the count of the ballots, the board of elections shall have the voting machine or automatic tabulating equipment tested to ascertain that it will accurately count the votes cast for all offices and on all questions and issues.

On completion of the election day count, the programs, test materials, and ballots shall be sealed and retained as provided for paper ballots in section 3505.31 of the Revised Code.

§ 3505.31. Disposition of ballots, pollbooks, poll lists or signature pollbooks, tally sheets.

When the results of the voting in a polling place on the day of an election have been determined and entered upon the proper forms and the certifications of those results have been signed by the precinct officials, those officials, before leaving the polling place, shall place all ballots that they have counted in containers provided for that purpose by the board of elections, and shall seal each container in a manner that it cannot be opened without breaking the seal or the material of which the container is made.

Preserved for 60 days after an election

In counties where voting machines are used, if an election is to be held within the sixty days immediately following a primary, general, or special election or within any period of time within which the ballots have been ordered preserved by the secretary of state or a court of competent jurisdiction, the board, after giving notice to all interested parties and affording them an opportunity to have a representative present, shall open the compartments of the machines and, without unlocking the machines, shall recanvass the vote cast in them as if a recount were being held. The results shall be certified by the board, and this certification shall be filed in the board's office and retained for the remainder of the period for which ballots must be kept. After preparation of the certificate, the counters may be turned back to zero, and the machines may be used for the election.
