from this affidavit that they have violated the integrity of the recount on several fronts. One interesting point is that Mr. Rapp told the New York Times this morning that it would be unusual for a rep to ask for the precincts being counted. Thay ordinarily they wouldn't ask for or need that information. The whole thing is enlightening.

Thanks for posting the link.

4. This is a huge smoking gun!! There needs to be depositions asap
In an affidavit filed along with the Cobb-Badnarik-Kerry filing that added recount tampering to their lawsuit, Professor of Computer Science Douglas Jones asserts that Triad Election Systems' visits to local Board of Elections compromises the credibility and integrity of the Ohio recount.

< This is big; there needs to be a deposition of the Triad Rep and election office officials asap. [br />How many offices did he hack(coverup fraud) the equipment in before the recount?
How many counties/precincts had compilers tampered with by Triad reps after the election or before the recount]

10. A PDF would be nice.
There's a reason why only PDFs are counted as equivalent to actual hard copys for citation and other purposes. There also a lot easier to keep and send to people.

Article 2, Section 1, U.S.Constitution:

The Congress may determine the Time of chusing the Electors, and the Day on which they shall give their Votes; which Day shall be the same throughout the United States

By whatever means necessary, there must be a declared winner in Ohio based on the votes cast on November 2.

23. Don't listen to him.
It does not forbid having a re-vote in the Constitution at all. It is not even mentioned or implied. There is, however, no precedence for such a thing in U.S. federal electoral history. That does not mean that it cannot happen. The clause he referred to has to do with the electoral college -- not the people as a whole. If he'd bothered to read the whole Article he would know that...

Good grief.

21. You're pulling that out of your ass "Constitution Guy"! Plllleeeazzzzeee
Edited on Wed Dec-15-04 11:42 PM by Stand and Fight
Give me a break fellow. You just interpreted the Constitution in your own twisted way! "...and the day on which they shall give their votes" means that the day the electoral college votes shall be the same day across the United States. Another thing -- if you are going to try to quote the Constitution, make sure you do it fairly. Besides -- your whole unreasonable interpretation is blown out of the sky when you reflect on one simple fact. EARLY VOTING OCCURRED ACROSS THE UNITED STATES THIS YEAR! So, stop trying to post shit that you don't know what you're talking about. Let's also not forget about absentee ballots... Don't believe me? Check out the following site: http://www.ncsl.org/programs/legman/elect/absentearly.htm

And so everyone else here doesn't fall for this person's absolute bullshit, here is Article 2, Section 1 and all applicable clauses of the United States Constitution:

Article. II.
Section. 1.

Clause 1: The executive Power shall be vested in a President of the United States of America. He shall hold his Office during the Term of four Years, and, together with the Vice President, chosen for the same Term, be elected, as follows

Clause 2: Each State shall appoint, in such Manner as the Legislature thereof may direct, a Number of Electors, equal to the whole Number of Senators and Representatives to which the State may be entitled in the Congress: but no Senator or Representative, or Person holding an Office of Trust or Profit under the United States, shall be appointed an Elector.

Clause 3: The Electors shall meet in their respective States, and vote by Ballot for two Persons, of whom one at least shall not be an Inhabitant of the same State with themselves. And they shall make a List of all the Persons voted for, and of the Number of Votes for each; which List they shall sign and certify, and transmit sealed to the Seat of the Government of the United States, directed to the President of the Senate. The President of the Senate shall, in the Presence of the Senate and House of Representatives, open all the Certificates, and the Votes shall then be counted. The Person having the greatest Number of Votes shall be the President, if such Number be a Majority of the whole Number of Electors appointed; and if there be more than one who have such Majority, and have an equal Number of Votes, then the House of Representatives shall immediately chuse by Ballot one of them for President; and if no Person have a Majority, then from the five highest on the List the said House shall in like Manner chuse the President. But in chusing the President, the Votes shall be taken by States, the Representation from each State having one Vote; A quorum for this Purpose shall consist of a Member or Members from two thirds of the States, and a Majority of all the States shall be necessary to a Choice. In every Case, after the Choice of the President, the Person having the greatest Number of Votes of the Electors shall be the Vice President. But if there should remain two or more who have equal Votes, the Senate shall chuse from them by Ballot the Vice President.

Clause 4: The Congress may determine the Time of chusing the Electors, and the Day on which they shall give their Votes; which Day shall be the same throughout the United States.

Clause 5: No Person except a natural born Citizen, or a Citizen of the United States, at the time of the Adoption of this Constitution, shall be eligible to the Office of President; neither shall any Person be eligible to that Office who shall not have attained to the Age of thirty five Years, and been fourteen Years a Resident within the United States.

Clause 6: In Case of the Removal of the President from Office, or of his Death, Resignation, or Inability to discharge the Powers and Duties of the said Office, the Same shall devolve on the VicePresident, and the Congress may by Law provide for the Case of Removal, Death, Resignation or Inability, both of the President and Vice President, declaring what Officer shall then act as President, and such Officer shall act accordingly, until the Disability be removed, or a President shall be elected.

Clause 7: The President shall, at stated Times, receive for his Services, a Compensation, which shall neither be encreased nor diminished during the Period for which he shall have been elected, and he shall not receive within that Period any other Emolument from the United States, or any of them.

Clause 8: Before he enter on the Execution of his Office, he shall take the following Oath or Affirmation:--"I do solemnly swear (or affirm) that I will faithfully execute the Office of President of the United States, and will to the best of my Ability, preserve, protect and defend the Constitution of the United States."

Section. 2.

Clause 1: The President shall be Commander in Chief of the Army and Navy of the United States, and of the Militia of the several States, when called into the actual Service of the United States; he may require the Opinion, in writing, of the principal Officer in each of the executive Departments, upon any Subject relating to the Duties of their respective Offices, and he shall have Power to grant Reprieves and Pardons for Offences against the United States, except in Cases of Impeachment.

Clause 2: He shall have Power, by and with the Advice and Consent of the Senate, to make Treaties, provided two thirds of the Senators present concur; and he shall nominate, and by and with the Advice and Consent of the Senate, shall appoint Ambassadors, other public Ministers and Consuls, Judges of the supreme Court, and all other Officers of the United States, whose Appointments are not herein otherwise provided for, and which shall be established by Law: but the Congress may by Law vest the Appointment of such inferior Officers, as they think proper, in the President alone, in the Courts of Law, or in the Heads of Departments.

Clause 3: The President shall have Power to fill up all Vacancies that may happen during the Recess of the Senate, by granting Commissions which shall expire at the End of their next Session.
Section. 3.

He shall from time to time give to the Congress Information of the State of the Union, and recommend to their Consideration such Measures as he shall judge necessary and expedient; he may, on extraordinary Occasions, convene both Houses, or either of them, and in Case of Disagreement between them, with Respect to the Time of Adjournment, he may adjourn them to such Time as he shall think proper; he shall receive Ambassadors and other public Ministers; he shall take Care that the Laws be faithfully executed, and shall Commission all the Officers of the United States.
Section. 4.

The President, Vice President and all civil Officers of the United States, shall be removed from Office on Impeachment for, and Conviction of, Treason, Bribery, or other high Crimes and Misdemeanors.

24. You better pull your foot out of your mouth...
It'd be best to research before you post, because that is how the Founding Fathers spelled it. Yep, "chusing." If you happen to read the Constitution you will see that our way of spelling things is different from theirs in many respects. Why? Since the Constitution is a historical and sacred document, we cannot alter it. Go to this site to see:
http://www.house.gov/Constitution/Constitution.html

It's posted on the House site, so I think they know what the hell they're doing...

Hey, you're welcome -- glad to be of service.

Unfortunately, the tone you believe I have has to do with your perception. I was actually being sarcastic. Therefore, I have no need to "take a breath." Typing is hard, but not the kind of "hard work" that our president has to do... So, I don't need a breather... LOL

ON EDIT: Nope. If he's gonna tangle with me, he better make sure he comes ready to dance and armed with facts -- not supposition.

get around the requirements by saying that the company had a maintenance contract to service the machines or would that still require notification and witnesses? Could the Republican and Democratic election supervisors that were there constitute having witnesses? Any ideas?

REPUBLICAN dominated Ohio Supreme Court

So, yes it is highly likely that he can get around the requirements, and your thoughtfulness may have just given them what they're surely looking for. Good reasoning on your part however. I truly wish that there was some sort of screening process to keep the FReepers out, don't you? I hate that they can view our discussions, rate down honest news articles, ruin petitions, and cause unrest on the boards...

34. What made me think of that was the KOS conversation that was had
with the owner, where he said they were REQUIRED to go in and reset the machines. I have every confidence that Arnebeck and Conyers have TWICE the minds of the Blackwell's out there and have thought all the aspects through.
And regarding the FReepers, hopefully they take the time to absorb some of what they read here and begin to see the reality of the world around them.

in the corporate world. He has been thinking about setting up a flawless, secure encryption voter card and a secure voting machine with a paper trail, stamped with the encrypted print out code. AND ALL PAERTS CAN BE INSPECTED AND SEALED. It would run by itself or be thrown out...no maintenance allowed

Well, I am not an engineer and I can grasp a basic understanding of what he's talking about.

BTW, MS has devised an encryption code that is impossible to break. It was announced last month.

Thanks for the information. You might want to google about India elections and they're voting equipment. They seem very happy with it, and it sounds a lot like -- from what I can recall off the top of my head -- what you are describing.

I'll have to look into the new MS encryption code that you've spoken of, OKthatsIT.

Thanks again. Something to think about.
