Arnebeck suit refiled...12/17

Voters Refile Challenge Of Presidential Results
Challenge

Backed By Jesse Jackson

POSTED: 6:03 pm EST December 17, 2004

COLUMBUS, Ohio -- Voters who said problems with voting machines Nov. 2 indicated fraud refiled a request with the Ohio Supreme Court on Friday to overturn the presidential results.

The 40 voters cite reports of machine errors, double-counting of some ballots and a shortage of voting machines in predominantly minority precincts as reasons to throw out the election results.

The challenge is backed by the Reverend Jesse Jackson and Cliff Arnebeck, a Columbus attorney for the Massachusetts-based Alliance for Democracy, who accused the campaign of President Bush of "high-tech vote stealing."

there checking for it, let me suggest that we all add our votes to his HEADLINE OF THE YEAR survey. Right now, a disturbing 63% have voted for "Bush Wins". Let's change them numbers! (Personally, I voted for the Red Sox headline as I can't disagree with Drudge on that).

Then I suggested we make it the winner, and it was yanked.

Coincidence? I think not.

43. READ IT!!!!
This may prove to be one of the most important documents in the nation's history. Can you imagine if they can prove it?

If anyone asks you about election fraud and what it is all about, you can direct them to this document. Print it and pass it out!!!

It's all in there...poll exits vs. official count, machine tampering, vote suppression, and vote count obstruction.

This is FANTASTIC!

31. dKos Diary on the AP article
http://www.dailykos.com/story/2004/12/18/729/66316

Some folk seem amazed that the AP story wasn't "snarky".

My assessment is that more than a few folk in the msm can count, at least. The number of hours that elapsed between dismissal and refile tell the whole story -- anticipated, planned, ready to launch, launched.

I suspect more has been planned.

Peace.

27. Why was it left out that the 2nd contested election was the judge's own!
These biased reporters are really starting to make me angry!

"Chief Justice Thomas Moyer of the state Supreme Court threw out the complaint Thursday, saying the voters improperly included a second election challenge in the complaint.

Moyer, a suburban Columbus Republican, said state law does not allow two elections to be challenged at once."

29. What will happen
The repug judges will look at the case. Weigh the evidence. Discuss if the issues pertain to Ohio case law or Constitutional law. Then get a call from
Robert Bennett (Head of the Ohio GOP) and find a reason to drop this case.

35. FWIW, This is what I sent to my Senators...
Senator :

I am a constituant of yours.

I believe that the Moss V. Bush case before the Ohio Supreme Court has merit. I doubt that your staff will have trouble finding it, but I reviewed a scanned PDF file of the case here: http://freepress.org/images/departments/Election_Contest_2.pdf Please inform me if this is not a true copy. I remind you that there is significant evidence yet to be presented in this case, and that discovery has not yet begun. The filing also mentions problems is 5 other States, but that court has no jurisdiction.

My familial history predates the founding of The United States. I likely have ancestors who participated in the Continential Congress (and later, others in the Wiskey Rebellion). The roots of patriotism run deep in me. I take this matter very seriously.

Although it appears to be a long held tradition in American Politics, I believe that the American people have evolved past the toleration of theft via electioneering (which is arguably an act of sedition). Just as they evolved past the holding of slaves, the denial of franchise to blacks and women, and et. cetera, we as a people can not continue tolerate this behavior from our "elected" officials.

I am writing to inform you that I am here watching your continued inaction closely. Your actions are being documented and that documentation will be available when you seek re-election.

Already documented is your inaction in 2000 regarding the Florida Presidential election theft. I feel this is partially excusable because the Supreme court did rule on a case concerning the matter, but, that ruling stopped a recount effort that later showed that Gore actually won Florida.

These are specific public actions by you that I would like to see in the historical record:

Publicly declare that that you will delay the acceptance of Electors from any State until court cases concerning those electors are resolved.

Support the efforts of U.S. Rep. Conyers to open Congressional investigations into the problems in the 2004 election.

Work towards the immediate appointment of a Special Prosecutor to investigate the election irregularities in all States named in Moss V. Bush, and, others as uncovered. Ensure that crimes uncovered in that investigation are persued fully.

I have the utmost confidence in your ability to persuade your colleagues that failure to act on these issues will undermine further the confidence of the American People in thier republic. I fear that the best case result of failure to act on these issues will be the genesis of a grass roots effort to reject all incumbents in future elections. The worst case scenario could include widescale riots or an armed defense of the Constitution.

I will be outside The Capitol on January 6 to demonstrate my support for your anticipated courageous actions in this matter.

Please keep me informed and let me know how I may assist you in upholding your oath of office.

-Hoot

39. Questions???
Edited on Sun Dec-19-04 01:08 AM by jkd
I have several question about the revised suit.

The supreme court judge is still mentioned in the law suit, should this disqualify him from sitting on the case?

What does "on information and belief" mean? These words were used to preface most of the allegations. I hope there is more information than belief.

Will the statistical anomalies really bare much weight?

40. "On information and belief"
From what I have read, "On information and belief" means that they believe this is true based on information they have received, but that they can't be accused of perjury if there are errors in their statement.
