12-21-04 (2nd Challenge of Supreme Court race refiledCOLUMBUS, Ohio -- Challengers of the Nov. 2 presidential vote in Ohio refiled a similar challenge on Tuesday against the re-election of Chief Justice Thomas Moyer of the Ohio Supreme Court over opponent Ellen Connally.
On Thursday, Moyer threw out the original challenge, ruling that state law does not allow voters to contest the results of more than one race in a single complaint. The plaintiffs had filed the challenges together.more: http://www.onnnews.com/Global/story.asp?S=2721149

3. My pet peeve with stories that cover the Connally/Kerry discrepancy |

The challenge also claims unusual differences in votes for Democratic presidential candidate John Kerry and Connally, also a Democrat. However, judicial candidates in Ohio general elections appear on the ballot without party affiliation.
They always throw out that line, that candidates appear without party affiliation. Are they saying Ohio voters are terminally ignorant of who represents which party when they're talking about the highest court in the state? For some reason, I think most voters who voted for Connally knew the following:
1. She is a Democrat 2. She is a woman of color.
If people are willing for a black female Democrat to hold such a high office in Ohio, an office which is responsible for issuing decisions on serious matters, it stands to reason those same people would vote for John Kerry.

4. It makes even a stronger point |

if voters didn't know the affiliation. We are asked to believe that a lesser known candidate with much less funding got disproportionately more votes than Kerry. Actually, it would make MORE sense if voters knew she was a Democrat and a woman of color that she received a high number of votes. So their argument actually works to opposite effect in trying to explain the discrepancy.

6. What is so striking about the information |

is Moyer's conflict of interest: Moyer threw out the original challenge, which was against the re-election of Moyer.
Moyer should have recused himself in the first place. His in-your-face gall is an example of how this administration has brought down the ethical standards of our government to the level of a deep hole. It's very suggestive that he feels protected from any repercussions from SCOTUS.

7. Then, the light of the press will make a spread sheet of Moyer's |

improprieties. Yeah, he's so Bushmob in his overreaching demeanor. He is nothing more than a coward looking for a way out. At some point, after some flagrantly unethical action, the ABA will have to step in.
That is, if the ABA is still clean.
Now I'm beginning to understand what it must have been like in Italy during the judicial purges. This is generic mobster behavior.
