First off, a huge thank you for your groundbreaking work.

Next, I had some questions you may be able to clarify.

The "papers in support of the motion" you referenced in your article, are those relating to the lawsuit State ex. rel David Yost et al v. National Voting Rights Institute et al, U.S. District Court Southern District of Ohio. Case No. 2:04-cv-01139?

If so, it might help to clarify matters. In that case, Kerry moved to intervene as a defendant, and that motion was accepted. Thus, while it is wrong to say Kerry has "filed suit", it would also be improper for people to assume that he in not involved in the legal action and is just sitting on the sidelines.

He is not only a Defendant in the case, but a counter-Plaintiff as well, and has been filing motions and memoranda for a couple weeks too.

Indeed, Kerry filed a motion for a preliminary injunction on December 10, which can be found here: http://moritzlaw.osu.edu/electionlaw/docs/Yost/kerry.pdf.

The motion filed by the Greens today is a motion to expedite, and you reported that Kerry will file paperwork in support of this motion. I thought your article was quite clear in stating that.

Just wanted to give people here at DU a heads up that Kerry isn't backing off, or shying away from legal action. He is indeed "in the fray".

1. This is not aimed at you, but...
OF COURSE HE IS IN THE FRAY!!!

Real legal work is not Hollywood legal work. It does not arc and resolve in 1.5 hours. It takes time to cross all the t's and dot all the i's, so the judge does not kill your case a'borning or if he does, you have a shot in appeal.

People got to get a handle on this need for instant gratification, especially when it comes to a case as complicated as this.

As I have said before: Kerry: former prosecutor. BCCI Investigation. If he's gonna be in this thing, he's gonna be in it to win it. Nothing else would be acceptable to a former prosecutor.

And besides, what prosecutor could ignore the world's largest and most motivated investigatory staff? ;-)

I have one...she is such a great pet!

And you're right about the instant gratification. The wheels of justice are slow to move... :)

My little girl, a vosMaeri who likes to take naps with me, under the covers and on my chest. ;-)

She also loves steak, chicken, spaghetti, fried rice, cheese grits, pizza, murders corned beef hash and eggs...

A real gourmand she is.

I feel that VERY firmly about his character. While he does take risks, he studies his options well, and cautiously (unlike Shrub)...before making a decision.

I feel confident now that he's "in"...but wish we weren't cutting-it-so-close to Jan. 6. The fact that they waited the extra few days 'til Monday delays it even more.

But, fingers crossed...

3. It should also be noted that Blackwell has filed a motion to dismiss
on 11/22/04 stating the National Voting rights Institute and Cobb/Badnirik have no standing to file suit.

Yeah, I checked out those threads. William's poem is great. :)

Lots of people around the internets read his article totally wrong, then got all disappointed Kerry wasn't filing a suit, but I just wanted to make sure people know that he has. :)
