The filing will be on Monday. It will be broader than we thought (that's all I know). The Green lawyer is very pleased about it.

The "broader" part is intriguing, but I refuse to allow myself to speculate. Well... I'm TRYING to not speculate. Arghh! Don't know for sure. Either gets us to the other side of the river, i.e. a full recount. Fraud is probably harder to prove.

updated on this.

The English here like Kerry and HATE bushie. In fact I was talking politics with two English couples at Christmas dinner yesterday. They were most interested in this filing. I have NOT talked to a single non US citizen who remotely likes bush and this is regardless of their economic status -- some Canadians & UK citizens here are quite wealthy. Americans here as a general rule are not talking politics -- they have clammed up.

The International Press has not caught wind of this -- yet.

The grunt level reporters are probably interested -- but as my International friends tell me -- everyone is afraid of bush. Anyway that's their impression of the way Blair caves to bush.

Right now there are no representatives of the International press on this island or any nearby island. The small local paper covers local issues -- and the local population keeps asking how 59 million American voters can be so stupid. I reply -- that number was hacked -- and that Kerry really did win.

It doesn't surprise anyone since it is widely believed that Gore won in 2000 and that bush would not leave the white house without a fight.

After reading some of the threads on this -- it appears that perhaps Kerry has taken the only route that can possibly lead him to the white house. He will have to shovel a hell of a lot of SHIT from the door to even get in the white house -- but it is fight now -- or forget about another democrat to ever get the keys to the white house.

And it takes time to prove vote fraud -- that the vote was hacked --

One thing I tell people (out here outside of the US) is that a major shift in news reporting is happening -- this vote fraud IS being reported on the Internet -- there are legitimate reporters (like WILL PITT) working on the Internet. News is breaking first on the Internet. It appears to me that Internet news sources will scoop this story and investigate it -- while even the UK mainstream media is waiting. Remember that the UK has really strong slander laws -- this was pointed out by several English snow birds. Bush has threatened UK newspapers -- and they maybe collecting info -- while playing it safe.

Truth Is All -- is doing an incredible job educating us about exit polls and polling in general.

The vote was hacked and the whole world is the victim of the fraud which has to go directly to the white house -- Rove has to be in control and he pulled the strings. Rove isn't one to just "let it happen".

so knowing whatever and however it breaks this next week, I got the one and only thing I wanted for Christmas this year already. Now into the New Year with a hint of potential to the holiday saying of Peace towards humankind. Only Kerry can get us close towards any kind of reconciliation given the carnage B*** has created.

I've got an old pre-election email pass around from a B***-voter in our family sent me, showing a video clip of voting machine that refuses to register the vote for Kerry. I saved it, knowing some day I would send it back to him with a message "guess you knew something I didn't, huh?"

(well didn't work for me anyway) and I'm not so techie that I know how to find the properties of the email forward I got from family republican pre-election. I'm too new here to start my own topic, but today's NY Times had a whole heap o'letters to the editors on the topic of election fraud...I think one of them questioned our motives..the others all exparessed the belief that the election was stolen.

Normally persons who are non-litigants have no standing in a case to request anything. Joe Citizen cannot ask the judge presiding over a case to expedite discovery or preserve evidence or any other thing unless he intervenes in the lawsuit and becomes a litigant.

I find it hard to believe Kerry would have any standing to do anything in court or ask for any kind of relief unless he becomes a litigant.

The only exception to this rule that I can think of is an amicus brief. But the purpose of an amicus brief is to inform the judge what the interested person thinks the LAW of the case should be, and almost always after the facts of the case are known. A request for expeditied discovery and preservation of evidence pertains to discovering the facts of the case and is not a means of informing the judge what someone thinks the law should be.

I'm racking my brain, but I can think of no instance where Kerry would have standing to ask the judge for an expedited hearing or for preservation of evidence unless he becomes a litigant first.

Can any lawyers out there conceive of any way he could possibly do this without becoming a litigant? Cause I sure can't.

For what its worth, this is 27 years of legal experience talking, and way too many court cases to count.

Usually you file what is called an intervention, meaning you want to intervene in an existing lawsuit. Sometimes an intervention takes court approval and sometimes one has an automatic right to intervene.

Usually court approval is a formality if you can show that you are truely an interested party in the subject matter of the litigation.

Kerry would have no problem showing that he was an interested party and any intervention by him would almost certainly be permitted.

As a litigant he would be called the intervenor, rather than a plaintiff or a defendant.

I just went to Will's initial post and looked carefully at what he said. He said:

"It should be noted that Kerry's filing of these requests does not indicate his complete entry into the recount process, but does clearly indicate that he is moving decisively in that direction."

I know Will has some legal knowledge. That could be Will's way of saying Kerry is going to intervene.

But technically, an intervenor is a litigant and has the same rights as any plaintiff or defendant. One can, however, intervene for very limited purposes so maybe that is what is being implied.

It is indeed quite fascinating and I am not sure what to make of it.

I am not a constitutional lawyer.

This also involves Congressional matters not the courts.

However, one thing did bother me and that was if the matter for some reason it made it to the federal courts as the author suggests it might. If it gets to the federal courts, I have my doubts, given Bush v. Gore, that it would come out in our favor. Dissenters in Bush v. Gore felt that the 2000 election should have been decided by congress, not by the Supreme Court. The majority of the court refused to allow it.

The trick in 2004 is to completely keep any election questions out of the federal courts, but if push comes to shove like it did last time, I am sure that is the first place the Republicans would head.

Our best shot was the people's vote, not the branches of government which are all controlled by one party.

The recount efforts will show that, and we know it will show it by how the nazis have reacted to the recount efforts there thus far. Once that is shown, shrub has gotta get out of the white house. So given the fact that it is clear that the recount will show Kerry won Ohio, and given that having won Ohio implies Kerry won the election, the only way for shrub to stay president, is if he forces him self into office, refuses to leave. Do you think shrub would do that? I would not put it past him.

So to rephrase your comment, what you are saying is that shrub essentially is going to refuse to relinquish power to the winner.

They were the main critics of Kerry before now.

I don't know if you can answer this, or how close you are to the situation personally, but does it seem as though Kerry is going about this just due to public pressure? Many of us have written to him, DNC, DLC, telling him if he doesn't fight the party is finished. Do you think he is going about this due to pressure, that his heart is not really in it? Just curious whether you know.

Because to me, it almost seems as though, at this late date, he's just going through the motions, trying to appease those who say he should fight. Is he really INTO it? Do you know?

MSM could NOT pick up a story like that . . . a presidential candidate sues over voter fraud . . . .

They will pick it up but they will also disclaim it as being ridiculous and that OF COURSE it won't make any difference.

The right wingers will be calling Kerry a sore loser.

just so everyone can go back and watch wife swap and not worry about the state of the "free world".

the freeps will say we are sore losers. cant let go blah blah blah. and guys we need to be strong, and let it all be soon we shall overcome.

but every time i see and hear one of the Dem's on CNN giving credit to this damn election like bush actually won fair i want to scream. so i hope this brings fraud out into the open and at least puts a question mark on this mans man date.
