Blackwell blocks precinct books viewing until AFTER Jan. 6th
The new Champaign County report describes how the precinct signature book, necessary to verify that the number of votes that were cast, will not be made available to recount observers until after January 10, per orders of Kenneth Blackwell (Secretary of State) (and, of course, Congress convenes on January 6 to receive the Electoral College votes, so irregularities discovered after that date are old news).

Edited on Mon Dec-27-04 03:01 PM by bunny planet
if he's breaking the law? Oldleftielawyer where are you? Kenneth Cruella de Harris Wormtongue Blackwell must be arrested for breaking the law! There must be a way. He is in blatant disregard of Ohio law for like, the third or fourth time. Isn't someone else legally accountable if they let him get away with breaking the law? Can't that person or persons be pressured? This so sucks. HELP!

49. The crowds in Ukraine protests were prepared before the election...
with major donations from the US. I saw one estimate of about $40 million poured into Ukraine by the International arms of the Democratic and Republican parties. Sizeable amounts were used before the election to plan for and talk up protests to happen immediately after the election if there was maybe, kind of, sort of any evidence of fraud that someone might someday find.

We had the Nov3 group that promised a response after the election if there was evidence of fraud -- it, of course, had nearly no funding and they waited several weeks for evidence to build. I think they are helping with the Jan 6th events in Washington.

My point is that we should want to emulate the Ukrainians, but that we ought not beat up on ourselves (or others) who haven't taken to the US streets in the millions.

Try typing in the message box, too.

Besides, even if the recount is over, the books are public records. We may view them whenever we like. So, why is it illegal? It isn't. Not now. Not ever. Try, again.

43. You sound so pleased with yourself
How does it feel to subvert the Constitution, the American people's will?
I have worked quite a bit with the elderly in the final years of their lives. EVERYONE reviews their life, thinking about how they have lived it, things they would do over, things they would do differently. NEVER has ANY of the hundreds of people that I have worked with remembered a wrong deed with fondness. I have spent many an hour comforting those whose regrets make them fear their death/maker (God).
I would pity you, but I have no time for you since my heart is breaking for America.

18. Maybe a few hundred emails to Keith O would make sense now?
Perhaps he can schedule an on-air interview with Katherine Blackwell to ask what it is he is afraid of showing to the world? After all, if he is not hiding anything, then all of this information should be part of the recount proceedings. Otherwise, I'd say that he is indeed hiding something and the American public. Any other ideas on how we can spread the word about this absurd decision?

How about using one of those email blasters to send notes to all of those mainstream media contacts to let them know about this?

Any other ideas? I really believe that this needs to get out to the public and to the media (for whatever that's worth).

26. Media contact for Ohio Election law:
Professor S. Candice Hoke
Associate Professor of Law
<http://www.law.csuohio.edu/faculty/hoke/>

J.D., Yale Law School
M.A. expected, University of Chicago, Graduate Faculty of Political Science
B.A., Hollins College

Professor Hoke specializes in the constitutional law governing legal relations between the federal and state governments, including in such regulatory areas as election law, welfare and public assistance programs, health/medical insurance, and employment law. She has served as a pro bono consultant to the US Senate Judiciary Committee and to the White House. Pertinent for the 2004 Ohio election litigation, Professor Hoke was an observer of many polling places in Cuyahoga County and personally witnessed poll workers issuing erroneous instructions to provisional ballot voters. Previously, Prof. Hoke taught law at the University of Pittsburgh and Case Western Reserve University law schools, litigated for both corporate and public interest firms, and served as a federal appellate law clerk. Her published work on constitutional and regulatory federalism issues is widely cited, and she serves as a media consultant on issues including the election law applicable in Ohio's 2004 election. Prof. Hoke was present at Cuyahoga County polling places on November 2, 2004, and personally witnessed poll workers giving voters erroneous instructions on how to complete provisional ballots.

42. If it's illegal why don't the lawyers know what to do about it???
Same thing with New Mexico recount. According to Cobb Website, asking for the 1.5 mil. for recount is illegal...but what to do about it? Shouldn't govenor Richardson intervene in New Mexico? But, how can he intervene with his state Supreme Court who refused to allow the recount to go forward?

It says it has to be taken to the US Supreme Court which will then in turn refuse to hear it...Yet if it's against state law WHO has jurisdiction in NM? Kerry will have to intervene in New Mexico just as Gore's lawyers did in Florida. Will he be willing to do that, given that Richardson is a fellow Dem?

It's all very complicated and seems that we aren't getting the help we need in time to do anything? :eyes:

I sincerely believe that they have seriously miscalculated and dismissed the indominable strength of the American Spirit! Oops!!!:)

62. He should be sued under thease grounds:
Taken from: http://www.truthout.org/docs_04/121604Z.shtml

There are several important considerations you should be aware of with respect to this matter. First, this course of conduct would appear to violate several provisions of federal law, in addition to the constitutional guarantees of equal protection and due process. 42 U.S.C. §1973 provides for criminal penalties against any person who, in any election for federal office, "knowingly and willfully deprives, defrauds, or attempts to defraud the residents of a State of a fair and impartially conducted election process, by . . . the procurement, casting, or tabulation of ballots that are known by the person to be materially false, fictitious, or fraudulent under the laws of the State in which the election is held." 42 U.S.C. § 1974 also requires the retention and preservation, for a period of twenty-two months from the date of a federal election, of all voting records and papers and makes it a felony for any person to "willfully steal, destroy, conceal, mutilate, or alter" any such record. Further, any tampering with ballots and/or election machinery would violate the constitutional rights of all citizens to vote and have their votes properly counted, as guaranteed by the Equal Protection and Due Process Clauses of the Fourteenth Amendment to the U.S. Constitution.

64. I thought this part was interesting from the link.
In Van Wert County, for example, our observer reported:

"When asked if Triad had serviced the machine, the deputy director and a board member stated that they had serviced the machine over the phone via modem on December 9th."

Doesn't this prove that they have distance access to the machines? If they can service the machine over the phone, what else can they do over...the...phone?

85. I find that strange when Allen County told us recounters that we could
have them this week for our own recounts from the area. I am surprised to hear this fact, really I am, I will have to phone my contacts over there tomorrow and see what is going on with that ??
