Arnebeck suit NOT THE SAME as the Green/Lib/Kerry suit
OK, I lied. One last.

Arnebeck's suit was filed before the Ohio Supreme Court, and was intended to go after the Electors and get Kerry into the Oval.

Kerry filed with the Green/Libertarian Party suit to get a recount in Federal court.

Two separate cases, but with some of the same people involved. Jon Bonifaz, for one, is working both.

Important distinction

37. There are at least FOUR suits
One in Federal Court in the Northern District of Ohio
One in Federal Court in the Southern District of Ohio
Two in the Ohio Supreme Court (the two Arnebecks)

I've got a total of four going so far.

35. Even so, they are sort of involved with the issue, and there's no
shortage of information from complete tin foil hat to videos of people waiting in the rain for hours only to be turned away at the polls.

Something went wrong, and whether it was fraud or incompetence it could very well have a real effect on the outcome.

and really, just read the stories. The fact that one case is in the Ohio SC and the other is in the Federal means they are two different cases.

"The filing by the Kerry/Edwards campaign is significant. The Yost matter deals with a recount of the votes cast in Ohio during the election. In order for a judge to consider such a motion, the plaintiff must be able to prove irreparable harm in the matter at hand, and must also be able to prove a significant chance that the case will succeed on the merits. The stumbling point for the Green Party and Libertarian Party in this matter has been the ability to prove that potential for success, because no recount would deliver an Ohio victory to them. A recount could very well deliver Ohio to Kerry, thus fulfilling the success on the merits requirement.

In the end, this filing amounts to a "Me, too" from the Kerry/Edwards campaign. This case would not exist in any form without the dedicated efforts of Green Party candidate David Cobb and Libertarian Party candidate Michael Badnarik. Though the inclusion of Kerry into this matter strengthens the case significantly, Cobb and Badnarik deserve the lion's share of credit for carrying the matter to this point."

39. It depends on what "filing" means
They're confused about the word "filing." They think it only means filing a lawsuit but actually one files a motion as well. Anything that you hand to the clerk of the court which is stamped in as filed is "filed." Some people joke that if it's in the proper format the clerk will "file" a restaurant menu (it's just a joke).

Answer: You don't just file suits. Anything that you give to the clerk that is stamped in is "filed."

20. What is the federal lawsuit for a recount? I am only aware of the motions
which are requests to the court for discovery and preservation of evidence.
If you are referring to the Delaware case, it was settled.

Last I heard motion denied for preliminary injunctions, etc. denied, Ohio Pukes had a motion to intervene, and the case was very much alive.

What were the terms of the settlement if you know and if you can say?

...of graduate students, professors, pundits, ....., will be writing about for the next 100 years, or more!!!

And, as to all the 'dimensions' of how folk are responding, as you know, it's totally to be expected. It's called chaos and it's going to get even more chaotic as 200+ million of our fellow citizens awaken to the realization that someone is stealing their democracy.

Coupled with all the good news Shrub has been generating since 3 Nov 2004 and the next 10-20 days are going to be like a civics class with 200+ million third graders and very few seasoned, reasoned teachers (Kerry, Byrd, Conyers, Carter, Jackson being among the best, for sure).

It's gonna be wild.

Good wine, good food, lot's of water and good exercise, plus an occasional nap is my protocol for not missing a moment of the greatest Constitutional-awareness event in the history of America.

Because that's the one that could actually counter all the disenfranchizement and fraud the Repukes used to steal the Ohio presidential race.

If Kerry doesn't back Arnebeck, we know he has absolutely no intention of contesting the 2004 election in a way that could actually overturn it.

That's exactly how it looks now. I would be happy to be proven wrong in the next few days, but EVERYTHING up to now has pointed in that direction.

Any symbolic moves he makes to the contest the election will probably only be done to prevent a mass exodus of black voters from the Democratic Party.

Each case has their own strengths and weaknesses. The judge may decide Arnebeck has no standing to file and toss the case.
