Karl Rove to be subpoenaed in OHIO matters...yessss.....

the link to the ABC news item and as reported also in the Kansas City Star website (same article evidently)says:

"On Dec. 21, officials learned lawyers for the voters planned to issue subpoenas to several high-ranking officials, including Blackwell, Bush and the president's political adviser, Karl Rove, according to Petro."

No wonder Blackwell and his gang are trying to have this thing killed dead.

72. Yes, so how did bush know in both 2000 and 2004
that he had won when no one else was able to discern it? He was so certain. They dragged in the VNS in 2000 and made them apologize for being wrong... except they were right.

Then again in 2004, the expensive exit polls were wrong, but Bush KNEW he had won. So, why don't we just use whatever service bush uses since he is always right while the others are wrong?

Better to start with Blackwell and smaller fry and work their way up.
Bush has a lot of resources to throw against them and it seems as if it would have been better to get as much from the state level players first before tripping that wire.

Federal Court filings only seeking depos of Brent Rapp and Michael Barbian, but does advise the court may be necessary as developed in discovery.

Rove ran the Bush campaign from the WH. Rove is a federal employee. The Hatch Act prohibits federal employees from participating in any campaign while they are at work. Rove's whole job inside the WH is a violation of this act.

* be candidates for public office in partisan elections
* engage in political activity while:
o on duty
o in a government office
o wearing an official uniform
o using a government vehicle
* wear partisan political buttons on duty

of the "Residence," and not an office. They couldn't have done that in a conference room in the West Wing because that would have been "in a government office."
What IS Rove's title other than "Bush's Brain" or Political advisor? Shouldn't he be on Bush's personal payroll and not on the government's? Because his work is primarily political, shouldn't he be working out of a private office?

What about when cabinet members went on the campaign trail with Bush and spoke to his hand selected audience? Weren't they there in an official capacity, like talking about how Bush "has made us safer?"

Isn't Air Force One a "Government Vehicle?" Were all those campaign trips paid for by public or private moneys?

81. Rove's activities on Election day and everyday
since Bush took office have been a violation of the Hatch Act.

Where Rove parked his fat butt on election night doesn't matter. Besides the WH is still, even the residence is Federal property. Bush doesn't own the place, despite whatever he believes, he just has the privilege of living there.

The fact that Rove was calling the MSM and SOE's across the country is the problem. He is violation of the Hatch Act because he was using his official authority or influence to interfere with an election.

Second, this is not the first and/or only time Rove has violated the Hatch Act. His whole job is a violation of the Hatch Act. Never before has a President had on paid WH staff a full time political consultant. By law, Rove should be paid by the Bush Campaign and he should have an office at campaign headquarters or the RNC, not inside the WH, where us sucker taxpayers have to pay for it.

on the GOP campaign from a White House dining room.

The GOP would have had to have hired the space, paying also for such things as electricity and phone lines, am I right?

And they'd have had to specify that the space was to be used for party-political purposes during the culminating hours of their election 'campaign', am I right?

This would be setting a new precedent, or am I wrong?

76. I agree with you....
Not on the factual part, but on the fact they have included shrub and rove. The suit will be dismissed. Why the hell did they include them??? Blackwell is all that was needed. Sometimes I think these lawyers are just going through the motions to pacify us. How could any reasonable attorney wanting the truth possibly damage a suit including shrub????
If I am wrong, I will apologize to the whole lot of them, but at this point, I am just pissed!

80. Sometimes you have to ask for more than you want,
in order to get what you want. It's like proposing a budget. I would never give my "needs" on the first pass - because everything gets trimmed down.

By doing this, they probably will throw out the shrub (but we'll get to that later); and Rove may become a ?, but there's enough to get Blackwell.

This is the Arnebeck suit (on behalf of Ohio voters), and he would have no reason whatever "to pacify us" (something that could possibly be suspected of K/E lawyers--different lawsuit).

I don't think that who you ask for, as to depositions, can be grounds for dismissal. If the judge doesn't like it, he just doesn't grant that motion. Not too sure of my legal ground here, but I've never heard of a dismissal for that reason.

Given Arnebeck's allegations, I think depositions of Bush and Rove are highly appropriate. They were in charge of the campaign (Bush theoretically, although he's never held to account for anything; Rove, in reality). (Bush could well know something, though I suspect they speak to him about this kind of thing in code. Blackwell, by the way, was B/C campaign chair in Ohio--blatant conflict of interest, and possible road of questioning.)

Well, subpoening Bush and Blackwell should finally bring the election fraud onto the mainstream news outlets; at least, I hope so. :)
