Floor Speech Of Congressman Dennis J. Kucinich On The Challenge To The Ohio Electoral College Vote

Congressman Dennis J. Kucinich (D-OH) gave the following speech today on the House floor during consideration of an objection to the certification of the Electoral College votes from Ohio:

“Let us not denigrate factual concerns about the Ohio election by dismissing them as simply partisan. This is not about Democrat or Republican votes. It is not about red or blue or black or white. It is not about wrong and right. It is not about winners or losers. It is about protecting voting rights in our democracy against corruption.

“Let us review just one of the very serious concerns with the Ohio election. Voting machines were misallocated causing some voters to stand in line for 10 hours. That denies voters equal protection of the law. In the states’ capitol, a shortage of machines in predominately African American communities was created. Even though the Secretary of State knew far in advance that 102,000 voters were registered in that county alone. The misallocation of machines was estimate to have denied at least 15,000 people the opportunity to vote.

“Furthermore the Secretary of State, who, under Ohio law has a constitutional duty to ensure election laws are upheld, failed to issue guidelines under the Help American Vote Act (HAVA) for two years. Contrary to the spirit of HAVA (which is to encourage voting and to have every vote count), Ohio’s top election official conducted the activities of his office in a most partisan manner, undermining public trust in the election. He sharply restricted the ability of voters to use provisional ballots. He endeavored to make it more difficult for lower income people, who are more likely to move, to vote.

“We know who won the election. But what the American people do not know is the extend to which voting irregularities in the State of Ohio deprived tens of thousands of my fellow citizens of their Fourteenth Amendment right to equal protection of the law and their constitutionally protected right to vote.

“The right to vote is expressly protected by the Fifteenth Amendment, the Nineteenth, the Twenty-Fourth and the Twenty-Sixth Amendments to the United States constitution.

“It is that right which has produced our very presence in this chamber. It is that right which binds us as a nation, which creates the unity of states, which legitimizes the government, which enfranchises not just a people, but in which reposes the treasure of the American people: A Government of the people, by the people and for the people. People have marched for that right, have put in their lives, their fortunes, their sacred honor on the line for that right, and the least we can do is show our commitment to protecting that right.

“The outcome of the election will remain unchanged. But what we must change is a system which denied citizens of a great state their opportunity to change the outcome. Election reform is our solemn duty. Out statements today show is we intend to do our duty.”

I was going down the escalator while Kucinich was riding up. I shouted across "Are you ready to make some history, Congressman?" and he shouted back "Yep!" Cool moment.

In other words, if those that wanted to vote where able to and those that did-have their vote counted and counted correctly-
Kerry would be president.

It's not much but it's enough for me to not stop believing in the good people of America and never ever believe Bushco has any "mandate" or has any legitimacy.

It's what I believed on November 2nd. I'm never going to believe that it was raining-the sun was in my eyes-and damn them that tell me they can see better than I.

Americans and America is better than that gang of thugs in the White House and D.C.

3. Boy, that's one of my biggest problems.
How am I supposed to pretend the people in power represent me, or most of the people I know, in the slightest? I've never lived in country where my LEADERS were such blatent criminals and thugs. I'm not quite sure how to approach life at the moment.

I wish I had a video. I made the mistake of watching the Senate hearing and I was watching that traitor Obama not realizing I was missing the speaker I most wanted to hear in the House. I understand Dennis wore an orange tie.

Dennis Kucinich stands tall while other Democrats fail the test of courage - One might even say, fail the test of being a Democrat.

BTW. This is the man that was totally rejected by the Democratic Party as their presidential nominee in favor of Senator “Reporting for Duty”.

10. Hastert has to be inundated with paper mail and publicity
in order the get the bi-partisan bill to have a paper audit (Hillary mentioned it in her speech, and Boxer was a co-sponsor). Let's reframe the issue--the validity of the vote.

15. He wasn't talking about the most votes. He knew Congress wouldn't
overturn the election - so legitimate or not Bush did win. Dennis has NEVER said Bush got more votes.

16. Again, he NEVER said Bush got more votes. He was talking of outcome
as a result of the fact that nothing we were doing was going to make Bush lose the White House.

The answer is this: The American people deserve to know that their votes count.

This is not about Ohio. This is about America. Bad election practices occurred in many places around the country. Ohio has become a focus because the election there was close and the loss of Ohio’s 20 electoral votes defeated Senator Kerry.

After the 2000 election fiasco, states were on notice that their procedures and safeguards had to be improved. Many states did the job, some did not. I don’t believe we should tolerate this situation any longer. I believe that it is time for the federal government to step in to make sure elections for federal offices are conducted legitimately so that all votes will be counted and all Americans can regain confidence in our electoral system.

Senator Kerry said yesterday that he will introduce comprehensive election reform legislation when the Senate reconvenes at the end of this month. I have already joined in some initiatives in the House that I believe are critical, including:
• abolishing the electoral college so the candidate supported by the most voters
nationwide will be declared the winner;
• making election day a federal holiday so voters who have to wait in lines won’t
be forced to give up their right to vote because they need to get back to work;
• requiring a verified paper receipt and paper trail for electronic screen voting
machines;
• allowing ex-felons who have completed their sentences to register
and vote;
• and fully funding the Help Americans Vote Act (HAVA).

This is a beginning. There are undoubtedly other needed reforms. I will continue to work on this issue until the problems are finally solved."

20. I voted for Dennis in the NYS Primary even though I knew Kerry would win.
Dennis continues to prove to be someone with Great Integrity, who backs up his words with actions.
