Please note that this research did not include absentee or provisional ballot legislation, or any other of the election related issues, except as included in the bills targeted for this directory.

The engine, listed here, provided a simple means to research state election reform legislation by state and subject.

For the current Bill Status, it is best to click the link which in almost all cases can lead to good spot on the state's web site.

It's draw back is it lacks links to the actual legislation. And getting to those can be tricky. But I've managed to get url's to these bill's status page, or at least to text of the bills.

And there are always a few stray cats to herd. I can't say every bill I found is on the NCSL page, and that's after notifying them.

The equipment would have to be in compliance with the federal Help America Vote Act (HAVA); would have to be tested and approved by the International Testing Association (ITA); provide a permanent paper record; and ensure anonymity. Each voting precinct would have to provide one piece of equipment or voting machine that complies with the Americans with Disabilities Act (ADA). Absentee balloting would be integrated with on-site and the ADA voting system.

Amends the Election Code. Provides that casting a provisional ballot in the incorrect precinct does not invalidate that ballot's votes. With respect to electronic voting systems, removes the requirement that a vendor's computer codes must be kept confidential. Makes those codes public records but permits a vendor to retain copyrights. With respect to reviewing the computer codes of electronic voting systems, requires that the State Board of Elections shall provide sufficiently qualified human and capital resources for conducting reviews and that the resources shall have no affiliation with voting systems vendors. With respect to audit trails of direct recording electronic voting systems, requires that all test results, documentation, and other records used to plan, execute, and review the results of testing and verification shall be public records. This bill revises the law (P.L.1992, c.3) establishing, in jurisdictions in which balloting is conducted by voting machine, a procedure for the use of paper "emergency ballots" whenever the machine becomes inoperable. Under the bill, the use of this emergency ballot procedure could be suspended for any particular election at the option of the superintendent of elections in counties having a superintendent of elections, or the county board of elections in all other counties. The superintendent or county board would be required to transmit notice of its determination to suspend use of the procedure at a particular election to the county clerk and, if appropriate, the municipal clerk not later than the 46th day preceding the election. The bill includes a provision prohibiting the legislation from being construed as authorizing implementation of an emergency or other special balloting procedure that does not conform to the statutorily prescribed procedure

House Bill 24 amends the Election Code with a requirement that an absent voter precinct board member, in the presence of two challengers from different political parties, create a duplicate of a rejected absentee ballot. Rejected absentee ballots are defined as ballots damaged, defective or marked in a manner that results in its rejection by a voting machine. The bill requires that the duplicate ballot be labeled with a serial number and then counted and tallied by a voting machine. The duplicate ballot would then accompany the original ballot and be handled in the same manner as an emergency ballot. If there is a recount, a candidate my request that rejected ballots and their duplicates be rechecked for accuracy and then recounted.

House Bill 27 amends the Election Code with a provision for any person to contest an election or request that the Secretary of State conduct a recheck or recount of a race if the winning margin of a candidate for governor or president is less than ten thousand votes or if there is an "undervote" of two percent or more in an election. An undervote is defined as the percentage of voters that voted in an election that did not cast a vote for any candidate for governor or president on the ballot. The requestor of the recount would also be allowed to have an independent expert examine or test the voting systems used in the election. The requestor of the recount would not be required to post a bond or otherwise incur expenses for the recount other than the deposit required by the Election Code.

I went to the Senate State Government Committee hearing, and testified on behalf of the New Jersey Tenants Organization (I'm President of the NJTO). S-29 was released from committee with some changes. The right of the Attorney General to waive the requirements for "good cause" was taken out, and language was added making it clear that the voter verified paper record is the official record of the vote. Unfortunately, the provisions do not have to be complied with until Jan. 1, 2008. It seems to me that the bill will move, since it was voted out of committee by unanimous, bipartisan vote. When the Essex County Freeholders learn of this, they may change their plans. If they don't, it would certainly make one wonder why they would be willing to throw out so much taxpayer money.
