Paperless voting unconstitutional: get your amended TN lawsuit right here
On Friday, I posted a draft lawsuit that will be filed in Tennessee within the week that declares that paperless electronic voting is unconstitutional in the Orange State. The response to that posting was phenomenal, with both posts (on 2004 ERD and GD-P) making it to the "Greatest" page and the lawsuit being cross-posted on daily Kos, VoteTrustUSA and seveal other election reform web-sites.

As a result of the excellent feedback we received, the lawsuit went through a number of revisions over the weekend. This morning, I received the latest version which incorporates many of the editorial comments received here on DU. Rather than posting the entire lawsuit again, I would be happy to email the latest draft to anyone who has an interest in it. If you would email me (tracevu@bellsouth.net) to request a copy of the latest draft, I will send it out directly to you. The lawsuit I will send will include the name and contact info for the Memphis attorney who is filing the suit. We would appreciate knowing which state you are writing from and whether you or others in your state would be interested in pursuing a similar lawsuit. We would certainly like to develop a cadre of like-minded election reform attorneys around our state and around the country who want to attack "vapor trail" voting as the unAmerican travesty that it is.

So email me for a copy of the latest draft of the lawsuit. And please kick, recommend and comment on our efforts. I would like to get this follow-up announcement out on the "Greatest" page also if at all possible.

The 2004 election theft evidence is overwhelming -- the Ohio Republi-Nazis are imploding -- Duh-bya's national approval rating is now in the 30s -- 21 Repug Senators are now polling in the 40s or less in their home states (and 7 of the 10 lowest ranked Senators are Repugs) -- more officials are coming forward every day saying that Diebold officials have tried to bribe them to use their equipment -- the NYT and WaPo have editorialized about the election fraud issue in the past week -- Ohio election officials are being indicted -- the good news just keeps on keeping on.

The election fraud parade has swelled to include almost 40% of the American people who now question whether their votes were counted as they were cast. Now it's time for John Kerry to be the good politician that he is and run around to get in front of this parade. With continued pressure, that may just happen. In the meantime, we need to work to declare paperless voting to be the unconstitutional "weapon of mass deception" that has almost destroyed this country and everything that "consent of the governed" stands for. Let the lawsuits begin!!

3. Annenberg Public Policy Institute -- two studies
One study, before the November, 2004 election, found that 38% of Americans questioned whether their votes would be counted as cast. (My source for that source is David Cobb.)

A second Annenberg study, released this spring, found that 35% of Americans believed that Bush won through election fraud. There were threads on DU 2004 ERD on this second Annenberg study which you can find through a "search".

5. people are starting to do the math
i find it amazing there is such cynicism about amending the law and making change. yeah, 40% of the people saw the lines and read abot the stories. this isn't conjecture. no CT. when the people lead it makes it a whole lot easier on the leaders to follow.

kick
