Cobb asks Bush administration to provide non-partisan support as well for the recount effort! Great news!

I think the critical part of this issue is the investigation into fraud. I hope that by joining the recount effort,this becomes just a piece of the big picture. I expect justice to be served to those that are responsible.

Sen. John F. Kerry's presidential campaign asked an Ohio judge yesterday to allow it to join a legal fight there over whether election officials in one county may sit out the state's impending recount.

A pair of third-party presidential candidates, who said that reports of problems at the polls on Election Day are not being addressed, are forcing the Buckeye State to recount its entire presidential vote. But David A. Yost, a lawyer for Delaware County, just outside Columbus, won a temporary restraining order last week blocking any recount there. He told the Columbus Dispatch that a second count would be a poor use of county resources. President Bush won the mostly Republican area handily, unofficial results show.

Lawyers for the Kerry campaign asked to join Green Party presidential candidate David Cobb, Libertarian candidate Michael Badnarik and the National Voting Rights Institute in the fight to force the county to participate in the recount. "If there's going to be a recount in Ohio, we don't want it to exclude Delaware County or any other county that might decide to follow Delaware County's lead," Kerry lawyer Dan Hoffheimer said. "It should be a full, fair and accurate recount."

WaPo also included this sentence toward the end: Bush won the critical battleground state by approximately 136,000 votes, a victory that also won him a second term.

Unfortunately, that sentence is in error. The SOS of Ohio has not even finished the initial certification of the vote count, much less the requested recount. So, how the heck does WaPo KNOW what the count or margin of victory or even the victor is?

So...........some of the 17,000 lawyers that Cam Kerry mentioned in his letter are now getting up off their barcaloungers.....take off the gloves, boys and girls!

Strong indications of major electronic glitches or fraud in Ohio in several counties

In analyzing the still-unofficial results, the totals reveal that C. Ellen Connally, an African-American Democratic candidate from Cleveland running for Ohio Chief Justice, received more than votes than Kerry in many counties. For example in Butler County, Connally received 5347 more votes than Kerry. The list of the counties where Connally actually outpolled Kerry include Auglaize, Brown, Butler, Clermont, Darke, Highland, Mercer, Miami, Putnam, Shelby, Van Wert, and Warren.

The reason the Kerry vote counts are suspect is because Connelly, a retired African-American judge, was vastly outspent in her race, and did not have the visibility of the presidential race. Thus for a more obscure Democratic candidate, farther down on the ticket, to get many more votes statewide than Kerry, suggests something happened to suggest there may have been a transfer of Kerry votes to Bush. ""Statistically, Kerry, as the Democratic presidential candidate, should have more votes than Connally. In a presidential election, most voters have the priority of casting a vote for president and the votes for president are almost always much higher than those of candidates farther down the ticket. As of election night, 5,481,804 votes were counted for Bush and Kerry. 4,327,270 votes were counted for Moyer and Connally.

""This looks like a computer glitch or a computer fix,"" said Bob Fitrakis, a lawyer, political scientist and Editor of the Columbus Free Press (http://freepres.org) who has written about election irregularities since Bush was declared the winner. Fitrakis is among the team of lawyers who announced they would soon file an election challenge in the state’s Supreme Court.

252. DailyKos had this story today as well
Some are advocating a re vote, not a recount. If machines gave the vote to someone else in error, it still gets counted that way, doesn't it? Isn't it amazing Kerry lost where he should have won in precincts with no paper trail? Those should get to re vote, I know Kerry won Ohio, I just know it.

We "Children of Israel" could have gotten ourselves in a lot of trouble worshipping idols and graven images and burning people in effigy while Moses was up on that mountain. At least it was only 28 days, 40 days would have been too much time to wait... :)

This would be an even more satisfying victory than if we had won outright on election night. However, and I don't want to put a damper on all of this joy that's flying around here, let's not get too excited too fast. Time is running out and we have to hope the lid blows really soon. This latest development, although important, is a small step in a very long and difficult process. Let's keep our fingers crossed and not give up, but let's not let our excitement with each small event get our hopes up so much that we're really let down if this doesn't happen in the end. Sorry, folks, just trying to be somewhat realistic.

it does mean that those who were questioning his very will to fight were wrong, so no matter the outcome, I for one feel much better. AND it's a good thing he didn't turn that leftover money to the DNC, or any other person/organization, because now he has it to use for the recount.

He hasn't let us down!!! That's the most important thing.

Please note that they aren't joining the recount itself. This is joining in a suit to overturn the injunction this judge granted against the recount. It doesn't sound like much more to me than filing an amicus brief. We'll see if they do more (unlikely, IMO).

contest! If the recount could alter the election results for the candidate (which we know it can for K/E) then the court is not likely to dismiss as was done in Nevada.

i'm not sure if many people realize that they are not (at this time) officially JOINING the full request of a recount for the state, but they are defending the right to have a recount in one county. At the same time, it shows they do give a damn and are paying attention to the detail of what's going on.

This small action speaks loudly, and it's only a matter of time before we see if they'll go further. It's a first step.

I am crying as I read what others have written, but I don't dare believe that this is the beginning of a real fight. I can't be disappointed again.I so much want Kerry to do battle for us. I have always felt that he is a good man and won't walk away. I will not celebrate yet though. There has been no announcement of anything by Kerry. All they are doing ,it seems to me, and I am a neophyte who used to work in her parents law office, is defending the GLIBS. And they are only defending the GLIBS in one county. I think this is comparatively low key way to support counting all the votes. And that may be all it is. I don't think K/E would be getting involved just to go through the motions. I sense they've undercovered enough compelling evidence to stay in the game.

I think it's a very interesting move to ask for a bi-partisan agreement to move forward by including a call out to Bush-Cheney. Remember, this isn't K/E asking for the bi-partisan show of support. Sort of pre-empts and diffuses the potential anti-Democratic Republican counter message that they most certainly will be cranking out soon.

I kept checking back here at DU to see if anyone had posted it yet, and then going back to the Cobb site to make sure I was reading what I thought I was reading. I finally decided, that since it was a press release, it was going to come out whether I posted it or someone else did.

I agree that its a very good idea to invite non-partisan participation from the Bush administration (not that there will be any). From the time right after the election, it has seemed to me that the number of people who question the results ALONE is reason enough for an investigation/recount. Although the polls that track such things have differed from 20% to 29% to as high as 39%, even the lowest number is WAY to high in an advanced democracy such as ours, imho. So, no matter WHAT the outcome, this is very good.

It's a boost, certainly since it's the first report of the Kerry campaign's active engagement. I'd like to see the document too. One way or the other, looks like the Kerry campaign is finally adding some legal heft to the Greens/Libs. The restraining order is outrageous and I can't see how it's legally defensible.

How far Kerry official legal participation will go....we'll see. But at least it's good to see some action since the "GLibs" have been leading the effort so far only with support and funding from individuals, much to their credit.

216. Which is why the GLibs were asking a court to intervene and allow the
recount to begin before SOS certification. What was holding up certification was the counting of the provisional votes which were handled separately. The GLibs were taking a shot. Courts have been known to do interesting things, regardless of law, on occasion. ;)

In analyzing the still-unofficial results, the totals reveal that C. Ellen Connally, an African-American Democratic candidate from Cleveland running for Ohio Chief Justice, received more than votes than Kerry in many counties. For example in Butler County, Connally received 5347 more votes than Kerry. The list of the counties where Connally actually outpolled Kerry include Auglaize, Brown, Butler, Clermont, Darke, Highland, Mercer, Miami, Putnam, Shelby, Van Wert, and Warren.

The reason the Kerry vote counts are suspect is because Connelly, a retired African-American judge, was vastly outspent in her race, and did not have the visibility of the presidential race. Thus for a more obscure Democratic candidate, farther down on the ticket, to get many more votes statewide than Kerry, suggests something happened to suggest there may have been a transfer of Kerry votes to Bush. ""Statistically, Kerry, as the Democratic presidential candidate, should have more votes than Connally. In a presidential election, most voters have the priority of casting a vote for president and the votes for president are almost always much higher than those of candidates farther down the ticket. As of election night, 5,481,804 votes were counted for Bush and Kerry. 4,327,270 votes were counted for Moyer and Connally.

""This looks like a computer glitch or a computer fix,"" said Bob Fitrakis, a lawyer, political scientist and Editor of the Columbus Free Press (http://freepres.org) who has written about election irregularities since Bush was declared the winner. Fitrakis is among the team of lawyers who announced they would soon file an election challenge in the state’s Supreme Court.

I never stopped believing in Kerry. During the first week after the "election" I was considering that people should drag Kerry out into the limelight and protest in front of wherever he is. But later on I figured that would have some serous consequences and letting the MSM in on this would aggravate the the monster known as the Wrong-wing spin machine. there's a pattern for about 50 years (or more now, i think) that the Redskins last home game before a presidential election determines who is going to win the election. it's been right every single time since they've been the Redskins.

The story is - if the Redskins win, the incumbent stays in power. If they lose, then the challenger will win.

This year, they LOST. Which would mean Kerry wins the Presidency. HOWEVER - during the game, there was a point where the Redskins scored and would have won the game - until it was called foul and they took back the points.........and the Packers ended up scoring, and winning the game in the end.

That makes me so happy. I fell asleep sometime after midnight late Nov 2nd with what I thought was a sure Kerry win. I feel like it has been a very bad nightmare and I'm ready to WAKE UP!!!

In light of all the information below, the intervention of the Kerry-Edwards attorneys is good news, but should not be unduly trumped as an unrealistic sign. Nonetheless, the fact that the Kerry-Edwards campaign is no longer taking an "under the radar" approach in the collective recount issue speaks volumes for those who would wish to speculate as to what their next move might be in the recount process. I feel I've said enough on this matter, so here is the information I've obtained:

Amicus Curiae

Definition: Latin term meaning "friend of the court". The name for a brief filed with the court by someone who is not a party to the case.

"... a phrase that literally means "friend of the court" -- someone who is not a party to the litigation, but who believes that the court's decision may affect its interest." William H. Rehnquist, The Supreme Court, page 89.

Amicus Curiae briefs are filed in many Supreme Court matters, both at the Petition for Writ of Certiorari stage, and when the Court is deciding a case on its merits. Some studies have shown a positive correlation between number of amicus briefs filed in support of granting certiorari, and the Court's decision to grant certiorari. Some friend of the court briefs provide valuable information about legal arguments, or how a case might affect people other than the parties to the case. Some organizations file friend of the court briefs in an attempt to "lobby" the Supreme Court, obtain media attention, or impress members.

"An amicus curiae brief that brings to the attention of the Court relevant matter not already brought to its attention by the parties may be of considerable help to the Court. An amicus curiae brief that does not serve this purpose burdens the Court, and its filing is not favored." Rule 37(1), Rules of the Supreme Court of the U.S.

"FRAP 29. BRIEF OF AN AMICUS CURIAE A brief of an amicus curiae may be filed only if accompanied by written consent of all parties, or by leave of court granted on motion or at the request of the court, except that consent or leave shall not be required when the brief is presented by the United States or an officer or agency thereof, or by a State, Territory or Commonwealth. The brief may be conditionally filed with the motion for leave. A motion for leave shall identify the interest of the applicant and shall state the reasons why a brief of an amicus curiae is desirable. Save as all parties otherwise consent, any amicus curiae shall file its brief within the time allowed the party whose position as to affirmance or reversal the amicus brief will support unless the court for cause shown shall grant leave for a later filing, in which event it shall specify within what period an opposing party may answer. A motion of an amicus curiae to participate in the oral argument will be granted only for extraordinary reasons." Rule 29. Federal Rules of Appellate Procedure.

263. We have no reason to believe they filed an amicus curiae.
You are right that it mainly pertains to the Supreme Court. The K/E Team has applied to join" and become a party to the lawsuit. They are not petioning to be a "friend of the court". Their position is more activist than that.

Well, at least it's something. I sure hope they do a hand count. My God, wouldn't it be just fucking awesome if...

a) They found out the Warren County numbers were off by thousands.

b) They found out the Butler County numbers were off by thousands.

c) They were forced to count those 92,000 undervotes and determine that about 80,000 of them were supposed to go to Kerry.

and d) They were forced to reconsider all the discarded provisional ballots.


I wonder what God thinks of Karl Rove. HA!

....and we all knew that Katherine Blackwell would never certify this election before the last possible minute (i.e Dec 3) meaning that the recount could never happen before Dec. 4. Kerry-Edwards have deprived Karl Rove and the Right Wing Spinmeisters of a solid month of smear time by laying low through the month of November. And choosing to step in now, because a county (very suspiciously) has said

"Ummm, excuse us, can we be exempted from the recount? Our dog ate our ballots. Did we say that?" (sweat drops) " What we really meant was, it wouldnt make any difference to the outcome anyway,and we have Christmas shopping to do"

is brilliant.

George Bush's victory in the US presidential election will be challenged in Ohio's supreme court today, when a group of Democratic voters will allege widespread fraud.
President Bush clinched re-election by winning the state of Ohio on November 2 by a margin of 136,000 votes over the Democratic candidate, John Kerry. Despite claims of fraud and technical glitches, Senator Kerry decided that they were not big enough to affect the result and conceded the election on November 3.

However, Cliff Arnebeck, a lawyer representing a group of voters challenging the Ohio result, claimed new analysis of various anomalies suggested it was rigged.

"We'll be calling for a reversal of the result based on evidence developed in the course of litigation," Mr Arnebeck told The Guardian yesterday. "Exit polling and substantial irregularities excluded votes that should have been counted. There is evidence that votes cast for one candidate were moved to the column of the other candidate."

Mr Arnebeck, a legal adviser to a liberal group, Alliance for Democracy, said the "contest of election" lawsuit will be presented to a judge from the Ohio supreme court today on behalf of at least 25 disgruntled voters. He said he expected other voters and organisations to join the case.

Ohio's secretary of state, Kenneth Blackwell, has until Monday to certify the result. His office did not return calls seeking comment yesterday but his spokesman, Carlo LoParo, told the Associated Press news agency: "There are no signs of widespread irregularities."

Mr Arnebeck said that hearings held in Ohio cities have brought to light new evidence of malpractice. He said one voter of a pro-Republican group caught destroying Democratic registration documents in Nevada before the election, had also been operating in Ohio.
