what would have to be proven? what would be the procedure?

just curious.

any thoughts?

1. I don't know the answer to your question, but...
if we have grounds to sue, it could be one of the largest class-action suits in U.S. history. If we don't have legal grounds to proceed on the fraud charges, it seems as though we have more than enough to sue to stop the use of electronic machines... maybe that suit would lead the way, open the door if you will, for the fraud suit. Let's get busy!:kick:

2. Don't know, but HAVA says the feds are supposed to certify the machines.
Interesting, isn't it? I'm just cruising around on a site describing the changes in HAVA and I happened across this:

5. Certification and Testing of Voting Systems - Section 231 referenced

* The commission will provide for the testing and certification of equipment. The states can also do their own testing and certification if they choose to do so.
* The Commission shall also accredit laboratories.

and I'm not certain its relevant, but I just am sort of wondering about equal protection issues again.

8. The machines and software ARE certified -- both nationally and
in most or all states as well.

But national and most state certification processes that I'm aware of are an absolute joke. Or, as I usually put it re the national certification: a joke or a scam or both.

3. maybe under some "equal protection" deal as was mentioned
elsewhere. An example is the voters in Las Vegas who voted on machines that do not record their vote on paper like the rest of the state voted on were not given equal protection, and this might be a bigger case if the voters were minorities. I haven't seen a breakdown of the population of Vegas by race yet but the largest minority population in the state is in Las Vegas....

4. Yes a private citizen or group of private citizens can sue.
The answer as to who has the burden of proof is in this thread.
Of course it requires a good lawyer to make the case.

6. If there's a class action suit, I'm in. I would love to sue the
rat bastards for this. Is there an attorney who would do it? Know of anyone? Know any citizens who are interested?
