Sharia courts conquer UK
http://www.rt.com/Top_News/2009-08-17/sharia-court-uk-islam.html
A recent study by think tank Civitas concluded there are around 85 Sharia courts currently operating in Britain, of which merely a dozen work within the British legal system.

While Muslim activists want to triple the number of courts by the end of the year, British human rights campaigners say Sharia justice is brutal.

There's also a desire establish an Islamic State within the UK and enact full Sharia law.

1. hmmm....sounds a bit like Utah, doesn't it?
Seriously, I can't believe the UK will let "full Sharia law" be enforced. Beheadings? Amputations? Legal abuse of women?

2. I doubt it'll get that far. The danger is a growing movement demanding it.

4. Analyze the source a bit
I found the source to be a weird think tank that I will be looking at a bit more closely.

6. I checked them out before posting.
It is an odd think tank but the facts they're working with are more the issue. Full Sharia law is barbaric, has no place in modern society, and allowing it to have any legal standing is dangerous. Honor killings are currently illegal in the UK but should proponents of establishing an Islamic state make more progress to that end, we could see those matters dismissed in a Sharia court instead.

7. But...
It really has absolutely no binding legal authority.

It is more akin to 'rules for being in our church' than anything.

Citing it as you do implies that it is actually very scary and dangerous.

And to point out a political bias.
The website warns away from the NHS system and suggests a mixed system in favor of one that works in Switzerland and the Netherlands. Of course those systems work despite private involvement, not because of it and they give no substantive reason why to select one of these systems over an NHS model.

8. Actually it does. If both parties agree to have the matter heard, its like binding arbitration
One of the concerns is that islamic women will be forced to accept sharia courts by their communities and family and not get what they should be entitled to.

11. So...because they might argue for a national health care system like in the Netherlands
It's not to be trusted?

The NHS isn't perfect and the group running the website apparently sees benefits to the system in Switzerland and the Netherlands. That isn't at all an indication that they're so biased as to not be trustworthy.

Some of the Sharia courts in the UK do have legal authority. If you had bothered to look into the issue rather than spend your time trying to discredit the article's source, you'd know that. Here's a link: http://www.timesonline.co.uk/tol/news/uk/crime/article4749183.ece

Sharia law is actually very scary and dangerous. Don't believe me, look at Saudi Arabia.

12. Uhm... on healthcare
It frames it context of advice to the US.

This stated the US does not have the Netherlands tradition of adversariality to such absurd disproportions of wealth. Some would argue that a 'single payer' system cannot work in the US because of the 30 plus year 'tradition' of private insurance.

I would argue that a mixed system that makes heavy use of private insurance would not work in a system that has such a positive view of shareholder maximization and greed. I would also suggest this 'advice' is a pointed critique of a system (NHS) that is far the superior to our absurd for-profit system.

And on the silly sharia nonsense-

It is entirely voluntary. You are Not compelled to seek religious arbitration except by your church in this event it is a voluntary contract for arbitration. I seriously doubt the younger generation is going to universally seek out guidance from these organizations.

And as to their effect despite being theoretically 'legally binding,' rules of jurisprudence with regards to appeals are still garaunteed.

13. Better to go to a news source that doesn't run to Anjem Choudary for quotes
Edited on Tue Aug-18-09 08:57 AM by muriel_volestrangler
Anjem Choudary is an extremist and self-appointed head of the "London School of Sharia" - which is run by him, and no-one else, and not recognised by anyone else. Choudary will say anything to get himself publicity and try to make himself look important.

Here's a news article about the Civitas report (yes, they are right wing, but not BNP types), from a more reliable source:

Dozens of sharia courts in the UK are regularly giving illegal advice on issues including marriage and divorce, a report published today claims.

Decisions concerning marriages not recognised under English law, polygamy, and disputes regarding children are being made by at least 85 sharia courts, according to the report by the thinktank Civitas.

There is no clear divide between the functions of imams and the sharia courts. An imam who conducts a marriage which is not registered and then advises on disputes within that marriage acts in breach of the law and outside the scope of the sharia court's role, Civitas say.

"Some of these courts are advising illegal actions," said Denis MacEoin, a former lecturer in Arabic and Islamic studies who wrote the report. "And others transgress human rights standards."
