Bryan Stow's family files lawsuit against the Dodgers..
Edited on Tue May-24-11 08:37 PM by Upton

The family of Bryan Stow, the San Francisco Giants fan who was severely beaten at Dodger Stadium, filed a civil lawsuit Tuesday claiming faulty security measures and defective facilities contributed to his attack, court officials said.

The lawsuit, filed in Los Angeles Superior Court, names the Los Angeles Dodgers Corp. and its owner, Frank McCourt, as defendants. The suit lists Stow's parents, Elizabeth Ann Stow and David Edward Stow, as plaintiffs on behalf of his two minor children, Tyler and Tabitha Stow, according to court spokeswoman Elizabeth Diaz.

Stow, 42, was attacked in the stadium parking lot after the first game of the Dodgers' and Giants' seasons on March 31. Stow, a paramedic by training, had gone to the game with friends in celebration of the Giants' World Series victory last season, a relative said.

After the game, two men came up to him in the parking lot and -- unprovoked -- began kicking and punching him while yelling profanities about the Giants, police said.

1. This is a frivolous lawsuit
I feel for Stow and hope he can recover fully, but to expect the Dodgers organization to actively police 30,000 fans at any given moment is absurd. As the article states, this was unprovoked and happened spontaneously. No one could have prevented it. The plaintiffs are going to have to prove negligence and that is going to be very difficult.

2. Who is going to pay for his medical care?
I saw one estimate today which has it the $40-$50 million dollar range. The Dodgers, under McCourt, allowed Dodger Stadium to become gangster central. Even after the Stow beating, McCourt tried to downplay the incident and even had to have extra security forced on him by the city of LA..

Read some of the comments in the LA Times whenever the issue of poor attendance or Stow is brought up.....many Dodger fans say they're scared to attend games, particularly if they have children, and have been that way for awhile..

Anyway, here's a full text of the lawsuit..
