2. Maybe not tomorrow but eventually courts will have to
basically because of equality. The reason for all of the civil rights court wins was because governments simply can't separate rights for some and not others. Brown v. Board, Loving v. Virginia, all the equal employment laws, equal housing, etc. are rooted in that. There is no justification for any government within the United States to exclude people from the rights of others. If it was argued correctly it may be a big surprise to you tomorrow, I hope so.

5. The CA Supreme Court
is a very liberal outfit, when they're given the right material to work with - the case, the arguments. Their rulings can only be as good as what is presented to them.

I'm hoping for the best, expecting the worst.

But, you're right - ultimately, equality must prevail.....................

16. In some ways liberal, but on precedent courts tend to be cautious.
My advice to everyone in this situation is, don't expect too much. Assume that Prop 8 is pretty much settled, and plan on another ballot initiative. If there's a pleasant surprise, okay, but don't set yourself up for disappointment.

I'm cautiously optimistic. Logic tells me that 2, if not 1 and 2, are very convincing arguments.

Proposition 8 Cases

Background
California voters approved Proposition 8, a state ballot initiative, at the November 4, 2008, statewide election. Proposition 8 added a new section to the state Constitution which provides that "Only marriage between a man and a woman is valid or recognized in California." The day after the election, three lawsuits challenging Prop. 8 were filed directly in the California Supreme Court.

On November 19, 2008, the Supreme Court agreed to hear those cases. The court directed the parties to brief and argue the following issues:
(1) Is Proposition 8 invalid because it constitutes a revision of, rather than an amendment to, the California Constitution?
(2) Does Proposition 8 violate the separation of powers doctrine under the California Constitution?
(3) If Proposition 8 is not unconstitutional, what is its effect, if any, on the marriages of same-sex couples performed before the adoption of Proposition 8?

In the order accepting the cases for review, the Supreme Court also denied a request to stay the operation of Proposition 8 pending the court's resolution of the cases, granted the motion of the official proponents of Proposition 8 to intervene in the action, and established an expedited briefing schedule. Briefing in the Supreme Court was completed on January 21, 2009. All briefs are available online on the Prop 8 page.

6. I'm hoping that the decision is for equality.
Fingers crossed. My backassward state could use some politicians who are willing to stand up for equality, but they are rare and silenced. The neutering of DOMA would go a long way from what I understand.

Please just know that those of us who live in bassawkard states are in the trenches with you, and will have your backs. :hug:

10. (hugs) to everyone.
I will be in class administering a final when the verdict comes down. I wish I could be here with DU but I can't. I'm trying to build a crazy streak of optimism. It would be so awesome if this were decided in the favor of equality.

13. They Have got to do the right thing or take "Just" out of Justice
and take "equal" out of the word "equality."

In any event, while I stay hopeful I also have butterflies in the gut-- the first time around Hate8 was so demeaning and gut wrenching.

Everyone please be safe - whatever the outcome we have many more roads and miles to travel together. :hi:
