Justice Kennard on the role of the judiciary: Anyone have this link?
I remember reading a blog posting on the prop 8 case in California that ended with the author concluding that prop 8 would be struck down by the court(Something I wish they did but at the time was firmly convinced they would not). This post had a wonderful snippet on it that was authored by Justice Joyce Kennard(California supreme court) regarding the role of the courts to constitutionally review statues, amendments, laws, etc. Basically, it laid out why it was absolutely the role of the court to look at things like equal rights cases and make decisions based off the California constitution. In essence, a response to people who have never taken a civics class and telling them why it was the role of the courts to do what they do and that it is a constitutionally designated role.

Anyone have a link to this post? I wanted to save that snippet but can't find it!
