On marriage equality legal rationales
Reading decisions and articles about DOMA, Prop 8 etc. I simply can't understand why the main strategy isn't to frame it as a gender equality issue. Simply put: A man can marry a woman so equally under the law a woman should be able to marry a woman. The same for a woman's right to marry a man, men should have that right too. Seems obvious to me.

Is this out there and I am missing it? Is there some flaw in my reasoning that legally won't hold water?

1. I certainly agree - and have often said we should just declare GLBT a religion
and then we get all the benefits and recognitions without all these court cases decided which Americans are approved to be full citizens rather than 2nd class ones - plus tax breaks

Simply put, it's discrimination in practically any argument one can make - and it's wrong, and it's past time for it to be over
