Marine faces charges in Iraq shooting

Marine Sgt. Jermaine A. Nelson is heading to a court-martial for allegedly shooting a detainee to death in November 2004 during combat operations in Fallujah, a news release from Camp Pendleton said.

Nelson faces six specifications of dereliction of duty and one specification of unpremeditated murder in connection with the incident, according to a Marine Corps Web site.

Nelson was assigned to Company K, 3rd Battalion, 1st Marine Regiment at the time of the incident.

Charges stemming from the incident were initially filed against Nelson in August 2007, but they were dismissed one month later when a new general was assigned to the case and decided to review the investigation to see if legal proceedings against Nelson should go forward.

Based on the results of a Naval Criminal Investigative Service investigation, charges against Nelson were filed again in December.
