Suit filed over guardsman not rehired as lawyer

INDIANAPOLIS — The Department of Justice is suing an Indianapolis law office on behalf of an attorney who was not rehired after his return from more than a year of active duty in the Indiana National Guard.

The suit filed Monday in U.S. District Court in Indianapolis says that in April 2004, after attorney Matthew B. Jeffries received an honorable discharge, he was told he would not be rehired by Mike Norris & Associates, where he had worked until his activation in February 2003. Most of his tour of duty was spent in Iraq.

The Associated Press left a telephone message seeking comment at Norris’ office on Tuesday.

The federal Uniformed Services Employment and Reemployment Rights Act generally requires that service members retain seniority, job status and pay levels during absences. The suit seeks payment for lost wages, benefits and opportunities, plus interest.

Jeffries now practices law in Evansville.
