Prosecutors say silence in CIA leak case may signal Rove indictment coming
Prosecutors say silence in CIA leak case may signal Rove indictment coming

RAW STORY
Published: Wednesday May 24, 2006

MSNBC's coverage of the CIA leak case continued Wednesday with new suggestions that presidential adviser Karl Rove may yet be indicted. The indictment of 'Bush's Brain' seemed imminent after reports from MSNBC and the Washington Post indicating that the Rove camp expected a decision earlier this month -- but it has now been 28 days since Rove testified for a fifth time before the grand jury investigating the outing of CIA officer Valerie Plame.

MSNBC's David Shuster says former federal prosecutors believe the silence from Special Prosecutor Patrick Fitzgerald doesn't bode well for Rove.

"Fitzgerald's office refuses to comment," Shuster said. "But former federal prosecutors describe the following procedure when considering an indictment: First, a prosecution team would review the evidence. Then, they would examine case law on the relevant criminal statutes. And finally, the prosecutors would decide whether a reasonable jury would convict at trial."

will Mr. Fitzgerald be lead counsel in the Rove trial, as well as the Libby trial? Is he as good in the courtroom as in case prep. or will he designate other talent to do the trials?

This investigation has not exactly been a linear process. No, like any good investigation, you open a door and it leads to other doors, IE: a holistic process.

The problem is that there are too many people thinking in a linear manner.

11. KKKarl the pawn?
Could it be?

My personal suspicion is that Rove has been dancing as fast as he can for months. I think Mr. Fitzgerald waits for KKKarl to come scurrying back into court to "explain things". After testimony, the prosecutor (Patrick!) reveals a new, incriminating piece of evidence against him. Rove regroups to think up a better lie and then scurries back...

I really wonder if the Special Prosecutor (Patrick!) is making KKKarl crazy on purpose so he'll give 'em Cheney. I think Rove is Fitgerald's (Patrick!) plaything in all this drama.

12. How do they get that out of this?
...The grand jury investigating the CIA leak case met again today at the courthouse. But prosecutors from Patrick Fitzgerald's office were not there... there was no sign the grand jury received evidence on presidential advisor Karl Rove. Rove's attorneys are waiting for a decision from Fitzgerald on whether Rove will be charged or cleared.

If he's still looking at evidence, he hasn't asked the GJ to hand up an indictment. It hasn't happened yet. Doesn't mean it will, doesn't mean it won't. I hope it does. But I see nothing here to suggest any movement yet. The one sentence that seems truthier than most is this:

But according to lawyers for other witnesses in the case, the only thing certain right now is that the investigation and focus on Rove continues.

14. what do you think the odds of Rove being indicted are?
100 to 1?
80 to 1?
60 to 1?
30 to 1?
20 to 1?
10 to 1?
or he will never be indicted at all, this is just a stall to keep stalling so the propaganda
will have a chance to catapult this away from the national attention.

24. I appreciate your posts Kpete
but to me this is not news at all, Schuster has been saying this for well over a month, maybe two so far, and for those of us paying attention this appears to prove what we've been saying, there was NO Target Letter received by Rove or Lusking on or before April 26th, and that there has been NO INDICTMENT..

MaDem says it all above..

This just isn't even news, repeater station echo of a real article/TV show being "reported" - the work on this issue was done by someone else, MSNBC.. thanks for watching tv for those who I guess are at work and can't watch themselves..

for once again differentiating between the indictment and the story.

One can be (hopefully) true, the other false. That fact seems to get lost here sometimes.

27. The Vitriol Was So Bitter That I Haven't Chimed In Until Now (more)
but I never doubted Leopold or Shuster. They are the real deal when it comes to journalists and both of them have said, in effect, the same thing, albeit one saying it with more assertiveness.

I wrote to Jason Leopold to express my support and ask that any supporters reading this do likewise. Drop me a private message if you'd like his personal email address.

39. Like most folks here
I ardently hope Shuster's right, but it's sort of kind of getting a bit embarrassing for him, isn't it? Tea leaf reading extraordinaire: if there's a lot of talk, that's bad for Rove; if no one is talking, that's bad for Rove; if the full moon is in Capricorn, presumably that's bad for Rove.

But of course it's like crack for us Fitz junkies ...
