1. I think we could get a better nominee. I don't know how many more

die-hard, absolutely sworn-in-blood die-hard Bush loyalits there are out there. At least, not of the stripe that Roberts and Alito are. We could get a hard rightist, a weasely one who can "cloak" his anti-choice, anti-civil rights views in selective amnesia and evasion, but even that would not be as bad as what Alito is: Someone who is essentially incapable of turning away from the Bush agenda. Ever.

2. It doesn't matter. Some battles must fought on principle.
I don't care if we filibuster every single fucking Bush nominee. If ONC SINGLE DEMOCRATIC LEADER had the balls to stand up and tell the American people that it simply is not proper to keep affirming special-interest rubber-stamp nominees while the president and his party and members of his administration are involved in so much fraud, then we would own the issue and be able to throw it back in the GOP's face. If Bush nominates another crazy, then we need a leader to say "Bush is nominating another party operative who is more concerned with protecting Bush and advancing Bush's imperialistic power than in protecting the rights of the American people." Period. OWN IT. Take control of this issue proudly instead of continuing to skulk away with our tails between our legs, worried that no one will like us.

How the hell much will America like us if we give away the country to the GOP just so we don't get soile on Sunday talk shows? It is madness to allow one more judge onto to ANY court until his legal and ethical problems are fully addressed, aired, solved, dealt with.

3. No, and that's your problem
Say we did filibuster Scalito away, and he just gave up and quit.

Great! We all have a big party, pat ourselves on the back and celebrate. And then...

Bush gets to pick the next nominee.

Filibustering takes a lot of political capital, and eventually even the most hard nosed Democrats would get tired of it and give up, even if they had the nerve in the first place.

5. No - remember Bush said
Harriet Meirs was the best person for the job - so anyone other than Harriet can't be better than second best.
