Tatel made two references to Plame's covert status. First, on page 28 of the opinion, Judge Tatel referred to Plame as an "alleged covert agent." Second, on page 38, Judge Tatel stated that because Fitzgerald had allegedly referred to Plame as "a . . . who had carried out covert work overseas within the last 5 years," in footnote 15 of a recent affidavit, Judge Tatel inferred that Mr. Fitzgerald must have at least "some support" for that conclusion.<190>. Because Special Counsel Fitzgerald's affidavit<191> does appear to assume that it is at least possible that Libby could be guilty of intentionally exposing the identity of a "covert" agent (see affidavit, fn. 15), Judge Tatel appears to have inferred that Fitzgerald had concluded that Plame was an agent who had carried out covert work within the last 5 years.<192>, <193>.

They can out Plame and leak classified info when it is politically expedient for them to do it, but when it comes to leaking politically damaging information that's classfied: TREASON!

Their duplicity and hypocracy is boundless. I can't wait till the next Democratic administration starts using the NSA to mine info against Republicans. I'm sure they'll defend his Presidential powers to do it.
