Chief Justice John Roberts, named to the court last September by Bush, was sidelined in the case because as an appeals court judge he had backed the government over Hamdan."

Chief Justice John Roberts did participate in the case because he ruled on the case, in favor of the government, at the appellate level.


The MSNBC link was to an AP article.

So much for the "Most Trusted Name in News", ya think? :eyes:

Chief Justice John Roberts did not vote, recusing himself because he ruled on the case at the appellate level.
