The greatest fear of Republicans losing the majority in either house is the power of the Congressional Subpoena. It means hearings, chaired by Democrats, being placed under oath to testify, having to produce documents and evidence of wrongdoing, relationships and links exposed to the public, oversight of the executive branch and corporate businesses.

It is the one weapon that in the right hands will bring down a corrupt Administration.

So when you next meet an arrogant Republican bemoaning the prospect of endless investigations if they lose the majority, tell them "That's right... and we have your subpoena waiting right here!"

If service of the summons and complaint is not made upon a defendant within 120 days after the filing of the complaint, the court, upon motion or on its own initiative after notice to the plaintiff, shall dismiss the action without prejudice as to that defendant or direct that service be effected within a specified time; provided that if the plaintiff shows good cause for the failure, the court shall extend the time for service for an appropriate period. This subdivision does not apply to service in a foreign country pursuant to subdivision (f) or (j)(1).

Which means that right now, quietly filed (perhaps under seal with the Court's permission) a Complaint could be ticking away, just waiting to be served to the Defendants.

4. There is a way to find those actions filed under seal .....

.... make use of your contacts within the Office of the Clerk of Court. While they are bound not to disclose any information contained in the Complaints filed under Seal, they are NOT prohibited from pointing out filings that have taken place. They are public servants, and owe this service to the public.

The purpose of having filings under seal included in a registry of civil actions is that the public has a right to know that complaints have been filed which do not disclose all of the parties, and the the nature of the relief requested. It also establishes the date of the commencement of the action for future reference as the case moves through the system.

Once you know a complaint has been filed under seal, you can track attempts at service connected to the assigned case number and that could lead to very interesting information .....

... having contacts in each district to make this kind of inquiry reduces the burden. We have only three districts in our state, so it is conceivable that three people could cover the entire state if they were coordinated in their search.

Eventually someone is going to set up a network to carry out comprehensive searches. Also, with the switchover to electronic filing, it is going to be easier to find complaints filed under seal once the system is fully implemented.

The bigger problem is when matters are filed in State Court. Then you need to look for possible sources of jurisdiction to begin your search. A much more imposing task.
