I don't think so, but Bush has given Cheney that 'right' with Executive Order 13292.

1. It isn't Constitutional for the Vice President and......
the President to be from the same state either, but that didn't stop them. All of the sudden Cheney's main residence was in Wyoming although he lived in Texas for years. Nothing stops these lying bastards. Nothing.

3. They CAN both be from the same state
They just can't both receive the electoral votes of that state:
"The electors shall meet in their respective states, and vote by ballot for two persons, of whom one at least shall not be an inhabitant of the same state with themselves."

4. Is that for the same office.....
or President-Vice President? I remember a heck of a lot of arguing about this in 2000, that they couldn't be from the same state. If I'm wrong......mea culpa. :)

6. Should have quoted Amendment 12
Edited on Sat Nov-04-06 07:12 PM by MUSTANG_2004
Since Amendment 12 overrides the section I quoted earlier:

"The electors shall meet in their respective states and vote by ballot for President and Vice-President, one of whom, at least, shall not be an inhabitant of the same state with themselves;"

As you can see, it would prevent Texas from casting electoral votes for both Bush and Cheney, but doesn't prohibit the President and VP from being from the same state.

Did anyone ever challenge it in court?

edited for typo.

7. I didn't use wikipedia to look up the Constitution
Edited on Sat Nov-04-06 07:04 PM by ck4829
I used it to look up a copy of the Executive Order, and when it comes to something like that, then I trust Wikipedia.
