Alito memo: shooting unarmed 15 year old in back of head is OK

Summary:

Memphis police officer Elton Hymon saw 15-year-old Edward Garner running from a house and shouted for him to halt. When Garner started to climb a chain-link fence in the backyard, Hymon shot him in the back of the head.

Garner, who was carrying $10 and a purse taken from the house, died at the hospital. His father sued police and the city.

In a Memo prepared for the Regan administration on the case, Alito contended that “a fleeing suspect in effect states to the police: ’Kill me or let me escape the legal process, at least for now.”’He added, “If every suspect could evade arrest by putting the state to this choice, societal order would quickly break down.”

Wouldn’t he make a great addition to the SCOTUS?

He has claimed that the federal government cannot fully apply the Family and Medical Leave Act to state employees. He has even argued that Congress could not enact a ban on the possession of machine guns. If confirmed, Alito could be a threat to our rights and liberties for a generation or more." ... "While working under Attorney General Edwin Meese, Alito urged President Reagan to veto a bill to protect consumers from used car dealers who roll back odometers - he said it wasn't the federal government's job to protect citizens' health, safety and welfare." ... "Alito supported a law that allowed a police officer to knowingly shoot in the back and kill an unarmed 15 year-old boy who fled a police attempt to arrest him as a suspect in a $10 burglary. In one case, Judge Alito joined in a 2-1 ruling that denied citizens access to courts under the Clean Water Act, which authorizes citizens to bring a civil enforcement action against alleged polluters. Judge Alito ruled that a citizen group did not have standing to sue because it had not
demonstrated that serious harm to the environment had occurred, despite the fact that the trial court had imposed a rare $2.6 million fine for the company's violations of the Act. The Supreme Court has since rejected Alito's analysis. Alito also wrote a dissent that would have unjustifiably restricted Congress' authority under the "Commerce Clause"
(which is the basis for most federal environmental laws) when he claimed that the law prohibiting the transfer or possession of machine guns was unconstitutional. What will he decide about laws protecting our environment?"

Justice Sandra Day O'Connor, whom Alito would replace, writing for the Supreme Court majority in rejecting Alito's husband-notification abortion decision:

Operation Rescue (radical anti-abortion group), commenting on Alito's nomination and the Roe v. Wade decision that legalized abortion:

"Roe's days are numbered. ... We are trusting that we are now on the fast-track to derailing Roe v. Wade as the law of the land."

He's a come a long way in his thinking, I guess. Killing a 15-year-old boy by shooting him in the back of the head is OK by Judge Sam Alito.

Sounds like he’ll fit right in with the White House that made it OK to torture children by squeezing their testicles.



Hey! In 1971, Alito spent his time bumming around Italy for his senior thesis. There are worse ways of spending time or eternity, like Vietnam.

Even if he only supports one of those, Alito's nomination should be toast. Unfortunately for the Constitution of the United States, he is in favor of all 14.

And thus, at essence, Son of Sam Alito is just the latest iteration of a long line of small-minded men. Those who feel it is their birthright to lord it over everyone else. In our history, such turds are called kings and fascists. NAZIs. Dictators. Under the Constitution of the United States, they have no business being here, let alone in charge.

That pretty much sums up what the BFEE has done to the United States of America. Machine Gun Sammy would, um, work see things stay that way.

WASHINGTON - Supreme Court nominee Samuel Alito defended the right of government officials to order domestic wiretaps for national security when he worked at the Reagan Justice Department, an echo of President Bush's rationale for spying on U.S. residents in the war on terror. Then an assistant to the solicitor general, Alito wrote a 1984 memo that provided insights on his views of government powers and legal recourse — seen now through the prism of Bush's actions — as well as clues to the judge's understanding of how the Supreme Court operates.

The National Archives released the memo and scores of other documents related to Alito on Friday; the Associated Press had requested the material under the Freedom of Information Act. The memo comes as Bush is under fire for secretly ordering domestic spying of suspected terrorists without a warrant.

Senate Judiciary Committee Chairman Arlen Specter, R-Pa., said Monday he would ask Alito about the president's authority at confirmation hearings beginning Jan. 9. The memo's release Friday prompted committee Democrats to signal that they will press the conservative jurist about executive powers.

The memo dealt with whether government officials should have blanket protection from lawsuits when authorizing wiretaps. "I do not question that the attorney general should have this immunity," Alito wrote. "But for tactical reasons, I would not raise the issue here."

Despite Alito's warning that the government would lose, the Reagan administration took the fight to the Supreme Court in the case of whether Nixon's attorney general, John Mitchell, could be sued for authorizing a warrantless domestic wiretap to gather information about a suspected terrorist plot.

9. I don't mind paying taxes either, but we should all share
the burden. Having said that, perhaps that .jpg is over-the-top. Believe it or not, it came from a coin forum. People are annoyed. I've deleted it once today; it's a bit raw. :evilgrin:

In an interview with the Republican-leaning blog RedState, former Attorney General Ed Meese accused Senator Kennedy of hypocrisy for asking Judge Sam Alito about conflicts of interest that occurred while he served as a federal judge.

"I would say again the attacks are political and it's totally hypocritical and false for anybody like Senator Kennedy, of all people, to question anyone's ethics, in view of his own past background. "

It’s a sorry day when the Republican party has stooped so low that Ed Meese has become its ethical guidepost. Meese may be well-versed in hypocrisy, but ethics is not his best subject.

Ed Meese was knee-deep in three separate Independent Counsel investigations, one of which – the Wedtech scandal – led to his resignation as Attorney General. After a 14-month investigation, Independent Counsel James McKay found that Meese "probably violated the criminal law" four times while he was the top law enforcement officer in the United States. The IC concluded that Meese filed a false income tax return, failed to pay capital gains taxes on time, and participated in decisions about matter in which he had a financial interest. Specifically, the report found that Meese gave preferential treatment to a former law school classmate who was an executive for a defense contractor who was seeking to build a pipeline through the Middle East.

Bonus: Alito was a Meese Assistant at the time….

Conservatives See Court Shift as Culmination

Last February, as rumors swirled about the failing health of Chief Justice William H. Rehnquist, a team of conservative grass-roots organizers, public relations specialists and legal strategists met to prepare a battle plan to ensure any vacancies were filled by like-minded jurists.

The team recruited conservative lawyers to study the records of 18 potential nominees — including Judges John G. Roberts Jr. and Samuel A. Alito Jr. — and trained more than three dozen lawyers across the country to respond to news reports on the president's eventual pick.

"We boxed them in," one lawyer present during the strategy meetings said with pride in an interview over the weekend. This lawyer and others present who described the meeting were granted anonymity because the meetings were confidential and because the team had told its allies not to exult publicly until the confirmation vote was cast.

Now, on the eve of what is expected to be the Senate confirmation of Judge Alito to the Supreme Court, coming four months after Chief Justice Roberts was installed, those planners stand on the brink of a watershed for the conservative movement.

In 1982, the year after Mr. Alito first joined the Reagan administration, that movement was little more than the handful of legal scholars who gathered at Yale for the first meeting of the Federalist Society, a newly formed conservative legal group.

I think it cannot be stressed enough how overturning Roe v Wade could affect privacy issues for everyone, and pave the way for a more totalitarian theocracy.

The avatar is from a collection by gay artist Robert Mapplethorpe who got Arnold to pose for him. I had to search far and wide for it and found an image at some obscure French website. :evilgrin: :evilgrin: :evilgrin:

Thanks for the heads-up on Mapplethorpe. Great photographer and a true artist.

Speaking of Arnold and the BFEE, remember Ed Meese was the AG who brought us Iran-Contra Drug Running. Meese even had a helper who helped re-write the regulations when the DEA could break the law and look the other way. His name is Samuel Alito.

The captains of the Reagan revolution at the Justice Department had two big concerns about a bookish new recruit named Samuel A. Alito Jr., who arrived in 1981: his blank slate as a conservative activist and his pedigree from a perceived bastion of legal liberalism.

"I wouldn't let most people from Yale Law School wash my car, let alone write my briefs," said Michael A. Carvin, a political deputy at the department.

Six years later, the revolutionaries saw Alito as one of them, tapping him to become U.S. attorney in New Jersey in 1987 and eventually, they hoped, a judge. Speaking on a New Jersey public affairs television program, the young prosecutor showcased the philosophy that had won the confidence of his Washington mentors.

Asked his opinion of President Ronald Reagan's nomination of Robert H. Bork to the Supreme Court, Alito gave a ringing defense of the conservative icon he said had been "unjustifiably rejected" by the Senate in one of the most ideologically polarizing nomination battles in decades.

In 1986, Attorney General Edwin I. Meese III disclosed that as much as $30 million from the covert sale of arms to Iran had been secretly diverted to anti-communist guerrillas in Nicaragua. Reynolds and Cooper said Alito helped craft the administration's defense of its actions.

Attorney General Edwin Meese III became directly involved in the Reagan Administration's secret plan to sell weapons to Iran in January 1986, when he was asked for a legal opinion to support the plan.1 When the secret arms sales became exposed in November 1986, raising questions of legality and prompting congressional and public scrutiny, Meese became the point man for the Reagan Administration's effort, in Meese's words, ``to limit the damage.'' 2

Meese began with an attempt to justify legally President Reagan's failure to notify Congress of the arms sales for more than a year. His efforts led to a November 21-24 fact-finding investigation focused on the President's involvement in the November 1985 HAWK missile shipment to Iran.

The Select Iran/contra Committees criticized Meese for departing from ``standard investigative techniques'' in his fact-finding mission because he failed to protect National Security Council documents, many of which were altered or destroyed as he conducted one-on-one interviews with senior Administration officials without taking notes.3 The Select Committees also faulted Meese for ``incorrectly'' stating in his November 25, 1986, press conference, at which he disclosed the Iran/contra diversion, that President Reagan did not learn of the 1985 shipment until February 1986. The Select Committees viewed this as an isolated error. It was not.

Meese was conducting the November 21-24 investigation as ``counselor'' and ``friend'' to the President, not as the nation's chief law enforcement officer. Independent Counsel concluded that he was not so much searching for the truth about the November 1985 HAWK shipment, as he was building a case of deniability for his client-in-fact, President Reagan. By this time, Meese knew that the 1985 HAWK transaction, in which the National Security Council staff and the Central Intelligence Agency were directly involved without a presidential covert-action Finding authorizing their involvement, raised serious legal questions. The President was potentially exposed to charges of illegal conduct if he was knowledgeable of the shipment and had not reported it to Congress, under the requirements of the Arms Export Control Act (AECA) and in the absence of a Finding. But Meese apparently never questioned the President himself about whether he approved or knew about the November 1985 HAWK shipment. When Meese got answers in his inquiry that did not support his defense of the President, he apparently ignored them, as he did with Secretary of State George P. Shultz's revelation on November 22 that the President had told him that he had known of the HAWK shipment in advance.

In the course of the weekend inquiry, Meese and his aides discovered in the National Security Council Office of Lt. Col. Oliver L. North a politically explosive document: An undated memorandum, apparently drafted in early April 1986, that outlined a planned diversion of $12 million in proceeds from the Iran arms sales to the Nicaraguan contras. This discovery caused the Meese inquiry to veer off onto two tracks -- while facts about the 1985 HAWK shipment were still being gathered, there was a second effort to determine who knew about and who approved the diversion. After receiving confirmation from North that an Iran/contra diversion had occurred, Meese quietly imparted the news to the President, White House Chief of Staff Donald T. Regan and Vice President Bush on November 24, sounding them out privately on their personal knowledge of it. He did not inform a senior advisers' meeting that afternoon. He informed the Cabinet on the next day.

Meese attempted to resolve the separate but continuing problem of the HAWK shipment -- particularly the President's contemporaneous knowledge -- at the senior advisers' meeting on Monday, November 24, attended by President Reagan, Vice President Bush, Regan, National Security Adviser John M. Poindexter, Shultz, Secretary of Defense Caspar W. Weinberger, and CIA Director William J. Casey. In response to a question about the November 1985 HAWK shipment, Poindexter falsely claimed that before December 1985, McFarlane handled the Iran arms sales ``all alone'' with ``no documentation.'' 4 Meese then added that the November 1985 HAWK shipment ``ay be a violation of law if arms shipped w/o a finding. But President did not know.'' 5 At least Meese, President Reagan, Regan, Shultz, Weinberger, Bush, and Poindexter knew that Meese's version was false, but no one spoke up to correct him. After the meeting, Shultz told his aide M. Charles Hill, ``They may lay all this off on Bud . . . They rearranging the record.'' 6

I know it's been a long time since Scooter Libby was indicted, so maybe Chris Matthews can be forgiven for appearing to have been so willing to be a useful idiot. Or maybe he's just one of the most gullible people in Washington DC:

MSNBC reporter Chris Matthews today hammered the Democratic Party, claiming it was circulating a document that emphasizes the fact Samuel Alito, President Bush's latest Supreme Court nominee, failed as a prosecutor to win a case against Italian mafia figures, suggesting the issue was highlighted because Alito is an Italian-American.

"I'm sitting here holding in my hands a pretty disgusting document," Matthews told viewers of "MSNBC Live." "This is put out not for attribution, but it comes from the Democrats. They're circulating it; I can say that."

In what he describes as a Democrat "complaint sheet," Matthews says, "The first thing they nail about this Italian American is he failed to win a mob conviction in a trial … way back in '88.

"In other words, they nail him on not putting some Italian mobsters in jail from the family. Why would they bring up this ethnically charged issue as the first item they raise against Judge Alito?"

The only reason I know about this claim is because I just turned on the television, and he was beginning Hardball with the same claim, that such a document was being circulated by "the Democrats."

I call bullshit.

For over a century, our government has made sure that we are never to be told the truth about anything that we have done to other people in third world countries, especially in Latin America. With the creation of the School of the Americas, a breeding ground for assassins, and the death squads, we have become the greatest human rights violators in the world.

We have become the most hated country in the world, not because we practice democracy or value our freedom. We are hated because our government denies these basic principles to these people. The hate has come back to haunt us in the form of terrorism, and as they say, once again, "the chickens have come home to roost" with our own homegrown American made terrorist, Luis Posada Carriles.

When I was posted in Central America as a DEA agent I saw Luis Posada and Felix Rodriguez, another American terrorist, at Illopango airport base in El Salvador. Joining them was a CIA asset Venezuelan advisor Victor Rivera. They had become part of what was known as a CIA apparatus that did not have to answer to anyone. They were involved in everything from drug trafficking to kidnapping to the training of the death squads. It was at the height of the Iran-Contra investigation that I had documented these atrocities to my government. I could not understand how our government had assisted in having Posada escape from a Venezuelan prison, and then placed him at Illopango airport as a CIA asset under the new name of Ramon Medina. He was now working hand in hand with then U. S. Lt. Col. Oliver North.

When I asked about Posada's presence at Illopango, I was once again told that it was a covert operation being run by the White House. I started to learn real fast that just about every time I questioned illegal action, I would be told that it was "a covert operation being run by the White House." And as we found out later, my allegations were facts; that became especially clear when, in 1990, President Bush Sr. pardoned another American-made terrorist, Posada's partner in crime: Orlando Bosch. To the degree that the "war on terror" is a response to actual terrorism, that terrorism is retaliation: the U.S. has exported death and violence to the four corners of the Earth with individuals like Posada and Bosch.

Posada admitted to a New York Times reporter that he organized a wave of bombings in Cuba in 1997 that killed an Italian tourist and injured others. However, he is best known as the prime suspect in the bombing of a Cuban Airlines flight in Barbados in October 1976. All 73 crewmembers and passengers including teenaged members of Cuba's national fencing team were killed.

Michael Levine is a veteran of 26 years of undercover work for four federal agencies. He is the recipient of many Justice and Treasury Department awards for hi s work undercover, including the International Narcotics Enforcement Officer Association's Octavio Gonzales Award. He is also the subject of Donald Goddard's book Undercover: The Secret Lives of a Federal Agent (Dell, 1990).

Joining the DEA (Drug Enforcement Administration) after discovering his brother's heroin addiction which eventually killed his brother, Levine was the most successful agent in DEA history. By 1977, he had made 3,000 drug arrests going undercover to set up buy and bust operations against New York City heroin and cocaine dealers. This led to his assignment as DEA station chief in Buenos Aires, Argentina.

By 1989, after having several of his operations stopped by higher ups who allowed his targets to get away, Levine quit the DEA in disgust. Levine then wrote the book Deep Cover (1990, Delacorte Press), describing his experiences that led to his leaving the DEA, exposing the government's phony "War on Drugs".

Levine tells a chilling story of treachery by members of his own agency, and the CIA, men Levine calls the ":suits" who he says use the War on Drugs as a cynical cover for covert foreign policy adventures. Levine says that since he began speaking out against the War on Drugs he has been threatened by high level DEA agents and has been the target of campaigns meant to discredit him.

I had been thinking about looking into the claim that during the civil war in Nicaragua in the eighties, the CIA helped move dope to the United States to buy guns for the contras, who were mounting an insurrection against the leftist Sandinistas. So I called up Hector Berrellez, a guy who worked under Mike Holm in Los Angeles, a guy known within the DEA as its Eliot Ness, and he said, "Look, the CIA is the best in the world. You're not going to beat them; you're never going to get a smoking gun. The best you're going to get is a little story from me."

After a while, the San Jose Mercury News series disappeared except on a few byways of the Internet, Gary Webb was ruined, and things went back to normal. Things like Oliver North's diary entry linking dope and guns for the contras, like Carlos Lehder, a big Colombian drug dealer, testifying as a prosecution witness in federal court during the Noriega trial about the Medellín cartel's $10 million donation to the contras, like the entire history of unseemly connections between the international drug world and the CIA--all this went away, as it has time and time again in the past. A kind of orthodoxy settled over the American press that assumed Webb's work had been thoroughly refuted. He became the Discredited Gary Webb.

HECTOR BERRELLEZ STUMBLED ONTO GARY WEBB'S STORY YEARS before Gary Webb knew a thing about it. ….

In September 1986, Sergeant Tom Gordon of the Los Angeles sheriff's narcotics strike force pieced together intelligence about a big-time drug ring in town run by Danilo Blandón. A month later, on October 23, Gordon went before a judge with a twenty-page detailed statement documenting that "monies gained from the sales of cocaine are transported m Florida and laundered.,.. The monies are filtered to the contra rebels to buy arms in the war in Nicaragua." He got a search warrant for the organization's stash houses. On Friday, October 24, there was a briefing of more than a hundred law-enforcement guys from the sheriff's office, the DEA, the FBI. That was the same day that President Ronald Reagan, after months of hassle, signed a $100 million aid bill that reactivated a licit cash flow to the beleaguered contras. And on Monday, October 27, at daybreak, the strike force simultaneously hit fourteen L. A. area stash houses connected with Blandón.

That's where just another day in the life of Hector Berrellez got weird. Generally, at that early hour, good dopers are out cold; the work tends toward long nights and sleeping in. As Berrellez remembers, "We were expecting to end up with a lot of coke." Instead, they got coffee and sometimes doughnuts. The house he hit had the lights on, and everyone, two men and a woman, was up. The guy who answered the door said, "Good morning; we've been expecting you. Come on in." The house was tidy, the beds were already made, and the damn coffee was on. The three residents were polite, even congenial. "It was obvious," says Berrellez, "that they were told." The place was clean; all fourteen houses were clean. The only thing Berrellez and the other guys found in the house was a professional scale.

But there was a safe, and Berrellez got one of the residents to open it reluctantly. Inside, he found records of kilos matched with amounts of money, an obvious dope ledger, a photograph of a guy in flight dress in front of what looked to be a military jet, and photographs of some guys in combat. Hector asked the guy who the hell the people in the photographs were, and the guy said, "Oh, they are freedom fighters."

And these guys knew Gary Webb, DUers may remember the Pulitzer-Prize winning reporter who was lauded for his groundbreaking series detailing how Contra-connected dealers got the inside track on the dope that eventually created the crack cocaine epidemic. Too bad what the government chose to “crack” down on was honest journalism, as protected by the First Amendment to the Constitution. Then it was only a matter of time before the rest of the Establishment press corpse piled on. Interesting expression: Kill a few birds with one stone.

Is that something? Three DEA agents who never knew of one another’s existence while they worked together in the federal government. There were united by something else, though. Each, after reporting drug dealing by Contras and other “protected organizations,” were left out to hang.

That’s un-American. Drug dealing to fund illegal wars? Gee. That’s Treason.

What are the names of those involved? We know a few: George Herbert Walker Bush, John Poindexter, Oliver North, Elliott Abrams, John Negroponte, Ted Shackley, to name a few. What's needed is a Grand Jury to investigate the actions of these drug-dealing, warmongering conspirators, for starters.

To them we can add "Samuel Alito."

don't forget the heroin (it was also given to Viet Nam soldiers to keep them occupied during extended duty) and I wonder what's happening with all the opium crop that is flourishing in Afghanistan, once again? What are all those CIA planes transporting in addition to prisoners?

Cannan also denied any connection with the so-called "Inslaw case." Wackenhut's name has come up consistently in relation to claims made by Michael Riconoscuito that while a research director for a joint venture between Wackenhut and the Cabazon Indians, he modified a stolen copy of Inslaw's PROMIS software for sale by Earl Brian to the Canadian government. Brian is a crony of Reagan's Attorney General, Edwin Meese. Meese is best known as gutter of the Fourth Amendment, and Wedtech scandal principal. Another former US Attorney, General Elliot Richardson, is the attorney for Inslaw. He has been quoted as saying that Inslaw "is far worse than Watergate." In fact, the Inslaw case does make Watergate look like a small town parking ticket fix. The press has barely scraped the surface of this most sordid of scandals, and not without reason. Among the few honest journalists to poke a nose in this nest of hornets and live to tell the tale is Jonathan Littman. According to Littman, Riconoscuito was a "consultant" for Wackenhut. According to Patrick Cannan, Riconoscuito was a "hanger on." Everyone is entitled to their own opinion.

The Inslaw case stems from the alleged theft of software by the Justice Dept. from the Inslaw Corp. It has grown from a title and bankruptcy case into one that includes allegations of sales of the software to foreign governments (such as Canada, Iraq, South Korea, Libya and Israel) by such Iran-Contra figures as Robert McFarlane and Richard Secord. The case attracted more public attention following the apparent suicide death of journalist Joseph D. "Danny" Casolaro on mid-August in a Martinsburg W. Va. motel room. Casolaro had told friends that he had made connections between Inslaw, Iran-Contra and the so-called "October Surprise." (allegations that representatives of the Reagan-Bush campaign team, headed by Casey, had convinced the Iranian government to delay release of American hostages until after the 1980 U.S. elections). Casolaro also allegedly told his brother that, if he was reported to have had an accident, not to be believe it. Elliot Richardson has demanded a federal investigation of Casolaro's death.

Cannan also denied that William Casey was legal counsel to Wackenhut before joining the government and that former CIA officials Frank Carlucci and Admiral Bobby Ray Inman were Wackenhut directors. Cannan said, "Although Casey's law firm represented Wackenhut, Casey himself never had any connection with us. Carlucci was a director of the firm -- he is no longer -- but Inman was not. We did have another director with a similar background to Inman, an admiral who was chief of naval operations, and that might have lead to the incorrect rumor."

Plausible deniability has been an American tradition at least since the Boston Tea Party. "The Indians did it." Right. Sure. Tell us another one.

As a young Justice Department lawyer, Supreme Court nominee Samuel A. Alito Jr. tried to help tip the balance of power between Congress and the White House a little more in favor of the executive branch.

In the 1980s, the Reagan administration, like other White Houses before and after, chafed at the reality that Congress's reach on the meaning of laws extends beyond the words of statutes passed on Capitol Hill. Judges may turn to the trail of statements lawmakers left behind in the Congressional Record when trying to glean the intent behind a law. The White House left no comparable record.

In a Feb. 5, 1986, draft memo, Alito, then deputy assistant attorney general in the Office of Legal Counsel, outlined a strategy for changing that. It laid out a case for having the president routinely issue statements about the meaning of statutes when he signs them into law.

Such "interpretive signing statements" would be a significant departure from run-of-the-mill bill signing pronouncements, which are "often little more than a press release," Alito wrote. The idea was to flag constitutional concerns and get courts to pay as much attention to the president's take on a law as to "legislative intent."

"Since the president's approval is just as important as that of the House or Senate, it seems to follow that the president's understanding of the bill should be just as important as that of Congress," Alito wrote. He later added that "by forcing some rethinking by courts, scholars, and litigants, it may help to curb some of the prevalent abuses of legislative history."

After the Hasenfus crash (see card #29), U.S. Attorney General Edwin Meese III delayed FBI and customs investigations of Southern Air Transport, the CIA company which had owned the downed plane. But U.S. missile sales to Iran were exposed in a Lebanese journal on November 4, 1986, and a full scale investigation became inevitable.
Meese told the press on November 25 that while on a fact-finding mission for the President, he had discovered a memo in Oliver North's office indicating that profits from the sale of missiles to Iran had been "diverted" to the contras. Meese stated that when he informed President Reagan o fhis discovery, the President had claimed total ignorance.

During the ensuing investigations, the question of whether or not Reagan had known about the diversion was debated at length. The more serious issue - the basic illegality of the war against Nicaragua - was all but ignored. Meese's inept handling of the investigation - his failure to secure North's office or to take notes while questioning the principals - allowed much avidence to be destroyed.

Edwin Meese was investigated repeatedly concerning allegations of influence- peddling and shady financial deals. He finally resigned on July6, 1988, claiming the investigations had "vindicated" him. Subsequent publication of the Special Prosecutor's report indicated, however, that Meese may well have committed criminal acts. Whether or not he obstructed justice during his term as chief law enforcement officer of the U.S. deserves further investigation.

Samuel Alito is a big booster of presidential power. Other "constitutional scholars" have been less sanguine.

On April 20, 1795, James Madison, who had just helped shepherd through the Constitution and Bill of Rights, and would become President of the United States in the following decade, wrote:

"Of all the enemies to public liberty war is, perhaps, the most to be dreaded because it comprises and develops the germ of every other. War is the parent of armies; from these proceed debts and taxes. And armies, and debts, and taxes are the known instruments for bringing the many under the domination of the few."
Reflecting on the ability of a president to use war as an excuse to become a virtual dictator, Madison continued his letter:

"In war, too, the discretionary power of the Executive is extended. Its influence in dealing out offices, honors, and emoluments is multiplied; and all the means of seducing the minds, are added to those of subduing the force of the people. The same malignant aspect in republicanism may be traced in the inequality of fortunes, and the opportunities of fraud, growing out of a state of war...and in the degeneracy of manners and morals, engendered by both.
"No nation," our fourth President and the Father of the Constitution concluded, "could preserve its freedom in the midst of continual warfare."


Since Madison's warning, "continual warfare" has been used both in fiction and in the real world.

In the novel "1984" by George Orwell, the way a seemingly democratic president kept his nation in a continual state of repression was by having a continuous war.

Cynics suggest the lesson wasn't lost on Lyndon Johnson or Richard Nixon, who both, they say, extended the Vietnam war so it coincidentally ran over election cycles, knowing that a wartime President's party is more likely to be reelected and has more power than a President in peacetime.

And, as George W. Bush told his biographer in 1999:

"One of the keys to being seen as a great leader is to be seen as commander in chief. My father had all this political capital built up when he drove the Iraqis out of Kuwait and he wasted it. If I have a chance to invade, if I had that much capital, I'm not going to waste it. I'm going to get everything passed that I want to get passed and I'm going to have a successful presidency."
Similarly, Adolf Hitler used the 1933 burning of the Reichstag (Parliament) building by a deranged Dutchman to declare a "war on terrorism," establish his legitimacy as a leader (even though he hadn't won a majority in the previous election).

When Republicans Loved a Filibuster

Supporters of George W. Bush are lambasting Sen. John Kerry for a threatened filibuster against U.S. Supreme Court nominee Samuel Alito. But 15 years ago, their attitude was different as backers of George H.W. Bush wielded the filibuster to block a probe into Republican secret dealings with Iran that could have doomed the Bush Dynasty.

In 1991, the Democratic-controlled Senate was planning an investigation into whether Republicans had conducted secret negotiations with Iran’s Islamic fundamentalist regime during the 1980 campaign, when Jimmy Carter was still President and Iran was holding 52 Americans hostage.

The unresolved hostage crisis destroyed Carter’s reelection hopes and gave an important boost to Ronald Reagan when the hostages were released on Jan. 20, 1981, immediately after he was sworn in as President and George H.W. Bush became Vice President.

A decade after those events, some Democrats wanted to get to the bottom of recurring allegations that George Bush Sr., a former CIA director, had joined clandestine negotiations with Iran in fall 1980 that may have delayed release of the hostages for political gain, what was called the “October Surprise” mystery.

Meanwhile, Republicans were worried that a full-scale October Surprise investigation might implicate Bush in near-treasonous talks with an enemy state and devastate his 1992 reelection campaign. Confirmation of the allegations also would have eviscerated the legitimacy of the Reagan-Bush era.

So, in November 1991, Republican leaders used the filibuster to block funding for the investigation. The Democrats mustered 51 votes – a majority – but fell short of the 60 votes needed for cloture. A fully funded investigation was prevented.

32. OMG. It's so easy to just forget some of this sometimes
It's so hard to be reminded of it. The whole story -- and we don't even KNOW the whole story -- is so overwhelming that you can almost (almost!) understand those quislings for whom the Truth is more than they can handle. Some days it's more than I can handle.

Every time we let them get away with something, they only got stronger and more daring -- until NOW, when Bush can be so daring and blatant that he just issues signing statements declaring that he IS the law, and there's no above him. For decades we let it happen. We stared evil in the face, blinked and looked the other way.

A Senate staffer confirmed that the Judiciary Committee received numerous "notes and letters" stating that Judge Samuel Alito is a member of Opus Dei.

In 1928, a Catholic priest who acquired a doctorate in law, Josemaría Escrivá founded Opus Dei in Spain. Escrivá's juridical attitude to religious doctrine permeates Opus Dei and is the source of its attraction to members of the legal profession. Opus Dei received massive political support after the fascist victory in the Spanish Civil War. Generalissimo Francisco Franco protected and fostered conservative elements within Opus Dei by appointing eight ministers to powerful positions in his government. In Spain, Opus Dei is still regarded as a potent political force. In 2002, Escrivá was canonized.

Why, then, is an Alito membership in Opus Dei of major significance? In addition to his activist record on the federal bench and his conservative ideology, Alito is deemed to be a menace to the balance of power as well as the constitutional rights of Americans. Judge Alito's affiliation with Opus Dei may be a factor in the strident opposition from Edward Kennedy and John Kerry, both progressive Roman Catholics who do not approve of the influence of religious dogma on political ideology. The majority of Americans believe in the separation of church and state, while many religious conservatives such as Pat Robertson and Jerry Falwell would transform America into a theocratic state. Robertson and Falwell are staunch supporters of Judge Alito.

While the Moral Majority, the 700 Club and a growing bloc of Christian Conservatives have wielded a great deal of political influence in America, two years ago these protestant fundamentalists formed a coalition with conservative Catholics to re-elect President George Bush. In 2004, the Vatican intervened directly into the US presidential election to endorse their champion, George Bush. The back-story is both fascinating and compelling, for it illuminates the political dynamics taking shape in the nomination, possible confirmation and conflict centring on Alito.

In June, 2004, soon after Bush's papal audience with the late pontiff, Pope John Paul II, a letter signed by Former Cardinal Josef Ratzinger, who now reigns as Pope Benedict XVI, threatened to excommunicate any Catholic politician in favour of abortion as well as any Catholic voters who would support Kerry at the polls. At that point in the presidential campaign George Bush was trailing John Kerry by double digits in the polls, and Bush seemed doomed to become a one-term president like his father.

During his papal audience with the late Pope John Paul II, Bush is reported to have complained to the pontiff and other members of the curia, including Former Cardinal Ratzinger, that he did not have the total support of all of the US Bishops. Ratzinger's letter swiftly resolved that dilemma for the politically beleaguered president.

(I know I spelled that wrong & I no longer have a copy).

I applied as a CO during the Vietnam war as a Taoist. My draft councilors warned me the army wouldn't accept non-Christian views easily and they were right. However, I felt I needed to be truthful.

Yes, I agree there are far more good folks than gangsters.
The good folks do not desire power over others and there is the rub!
The gangsters accumulate power and wealth and use violence to do so.
This is just not in our natures.

Two recent polls, a Los Angeles Times/Bloomberg poll and a New York Times/CBS News poll, indicate why Bush is getting away with impeachable offenses. Half of the US population is incapable of acquiring, processing and understanding information.

Much of the problem is the media itself, which serves as a disinformation agency for the Bush administration. Fox "News" and right-wing talk radio are the worst, but with propagandistic outlets setting the standard for truth and patriotism, all of the media is affected to some degree.

Despite the media's failure, about half the population has managed to discern that the US invasion of Iraq has not made them safer and that the Bush administration's assault on civil liberties is not a necessary component of the war on terror. The problem, thus, lies with the absence of due diligence on the part of the other half of the population.

Consider the New York Times/CBS poll. Sixty-four percent of the respondents have concerns about losing civil liberties as a result of anti-terrorism measures put in place by President Bush. Yet, 53 percent approve of spying without obtaining court warrants "in order to reduce the threat of terrorism."

Why does any American think that spying without a warrant has any more effect in reducing the threat of terrorism than spying with a warrant? The Foreign Intelligence Surveillance Act, which Bush is disobeying, requires the executive to obtain from a secret panel of federal judges a warrant for spying on Americans. The purpose of the law is to prevent a president from spying for partisan political reasons. The law permits the president to spy first (for 72 hours) and then come to the court for permission. As the court meets in secret, spying without a warrant is no more effective in reducing the threat of terrorism than spying with a warrant.
