I agree, we must not sit on our hands about this. We need to make as much ruckus about this as we did Alito. They would not be expecting it twice in one month, let alone one election cycle.

Have not scheduled one.
Without their amazingly convenient power to pull permits and sublimate and divide popular anger at just the right times, what chance do you think we have of forming a rival protest movement that would not be just as quickly infiltrated by faux "crazies"?
We already have in the USA what Arlen Specter is simply trying to make official.
Bringing legislation in line with existing practices, as it were.
Helps explain his statement to that effect.
He's trying to avoid trouble for the Bush administration when they proceed to expand and make public existing domestic security / psyops programs. He knows now there will be no political fallout from doing so. NSA revelations (of practices most people in the media and in IT already heard about years ago) were merely a trial balloon.
Ramsey Clark et al. are simply playing the Syphod-Dias role,
in the federal criminologists' longstanding effort to manage and control assembly and dissent in a nominal 1st-Amendment state.
