Judge dismisses unfair practices case against nurses union

A federal administrative law judge has dismissed a complaint brought by a nonunion nurse at Pomona Valley Hospital Medical Center alleging that the union representing nurses at the hospital engaged in unfair labor practices.

Nurse Carole Jean Badertscher accused the Service Employees International Union Local 121RN of intimidating nonunion nurses last year during contract negotiations between the union and the hospital.

The complaint includes two allegations.

The first alleges that the union violated the law in October 2007 when it distributed a flier describing a California law that criminalizes "professional" strikebreaking.

The other allegation related to a flier distributed by the union in October 2007 stating that union members are required to pay union dues even when the contract between the union and the hospital had lapsed.

Administrative Law Judge William G. Kocol on Nov. 19 dismissed both allegations.
