Lawsuit filed in UNITED STATES DISTRICT COURT (SOUTHERN DISTRICT OF INDIANA) by one lone PATRIOT officially naming as defendants:


U.S. Congress, Both the Senate and House
Department of Treasury
Board of Governors and U.S. Administration, The President Of The United States


Snidbits of lawsuit below:

This Constitutional action now challenges (H.R 1424), with direction to the part now known to the American public and to law as the "Emergency Economic Stabilization Act of 2008", in the fact that its use and misuse by the United States Government and the named Defendants with out regard to its over all impact to the "common America citizen" is in its self a violation of the fiduciary duty under the Constitution of the United States Government.

He comes now to this Court not as a lawyers seeking money nor as a writer of great works but, because there is no law in the use of the American taxpayer's money and there has been no accountability set forth that has been followed. The Plaintiff seeks the court to stop the misuse of the Tax payer's money ....

The Plaintiff as a citizen of this country now feels that without Americans speaking out and doing all they can Tax payers money will be spent to the point of destruction and further more it is his understanding as with all Americans that any money spent to help home owners should not be used to bailout the very people that misused it to pray on those who needed a home.

The Plaintiff feels that in the light of the theft of billions of dollars by investors and the misuse of laws in the case of credit reports, along with the total loss of accountability of billions of Tax payer's money some one must stand up and ask why? It is the way and the reason set forth in my complaint one must ask in this year of history making, must we make history in destroying our country to make some rich and other even poorer that before.
As stated he now requests the court;

PRAYER FOR RELIEF


WHEREFORE, Plaintiff asks this court

• To declare that the Defendants have violated the public trust and the United State Constitution in it fiduciary duty to
American Tax payers.

• to declare that Congress' disbursements of public funds to any bank or holding company are stopped until facts about how the
money has been spent to this time by those that have received money and these facts be submitted to this court and the
American people.

• to stop the use and misuse of credit reports to increase wealth and the total amount of loans, of insurance cost, and the
disqualification for employment.

• to permanently enjoin the improper disbursement of public funds with out proper full accountability in the use of the funds
as set out in this filing.

• to permanently enjoin Defendants' policy and practice of approving, endorsing, promoting, funding and supporting companies
and banks outside of what has been demanded in the law.

• to make the Defendants' comply with the law as written in the fact that the home owners of this country should have been the
first on the list to receive help under this act.

• the Plaintiff does not seek any money in this action he request that the Government be made to respond to the people not the
owners of the biggest banks and holding companies.

• to request the court order that on more money be released until the Government ensures accountability that the money spent
to this point has been done as enacted by law and that the first and only use of said money should be to help the American
tax payer.

• that the Court order that the money left over some 350 billion not be used or spent to enrich the lives of the few at the
cost of so many.

5. No constitutional standing
Usually when you sue for a grievance common to all taxpayers, the court will deem the case non-justiciable because the proper remedy is to vote for new representatives to change policy. It depends on who is in the court and standing is a largely political question, but separation of powers usually prevents the courts from intervening in pure public policy questions. It is different in the case of individual rights, where a private remedy may require constitutional interpretation.

I am a huge supporter of a federal public trust doctrine... but it hasn't really been accepted by the Supreme Court in a long time.
