California Attorney General Jerry Brown - calls Prop 8 'unconstitutional' going against the equal protection clause. He notes that the California Supreme Court's initial ruling said there was 'fundamental liberty interest' involved in granting marriage rights to same sex couples - so the fact that voters chose to override this interest does not diminish that they ruled on this issue ahead of Prop 8.
