MSNBC Countdown w/ KEITH OLBERMANN - 4 May 2010: Keith reacts to Sen. McCain's ridiculous pandering in calling for the Times Square suspect to not be read his Miranda Rights.

OLBERMANN: "As promised, the briefest of special comments on the statements by the senior senator from Arizona after the arrest of Faisal Shahzad, the suspected Times Square terrorist.

'Don't give this guy his Miranda Rights until we find out what it's all about,' said John McCain. 'Obviously that would be a serious mistake, at least until we find out as much information we have...'

Mr. McCain. Apart from the obvious fact that following your advice could mean that because of you Shahzad could walk free on technicalities, it is clear that your comments reveal your utter lack of faith in the system of justice that has keep this country free and safe for two hundred and thirty-four years. The laws are not there to be switched on and off at your discretion, senator. They're not there to be applicable to ALL EXCEPT... When you are having trouble getting renominated and you need to boost your poll numbers with the lunatic fringe in Arizona, this man, whatever utter reprehensible thing he appears to be, is an American citizen.

And if you can decide that he shouldn't have the same rights we would give to man who shot President Reagan, or to serial killers, or to Bernie Madoff, then the precedent that you set in doing so can someday end thusly:

Someday, for some crap reason, someone will be able to arrest YOU, Mr. McCain, and declare that YOU are not entitled to your Miranda Rights and perhaps YOU should be tried by a military court. While you pander to a group that tries to dress up its bitching about paying its fair share of taxes as 'The government is taking away freedom,' YOU propose that the government should take away freedom.

You shame yourself in the eyes of American patriots, and in the eyes of your fellow veterans who sacrificed, and the honored dead who gave their lives to protect the freedoms and the laws you have today suggested should be optional.

Freedom-loving Americans look back with horror at what could have happened on Saturday night six blocks from here... And we also look back with horror at how a man who thinks America is some kind of brand name, who does not respect the laws and honor of this great nation, could have come so perilously close to becoming its leader."

An excellent idea. According to real men who were in captivity same time as McCain, he's a rat traitor who sold out his country and got special treatment as a result. He SHOULD have been court martialed and dealt with an any traitor would. The fact that this SOB is walking around, is a senator (!) and ran for President (!!!!) is.. well, shameful is too good a word. How about.. disgusting.

20. His case is a clear example of how the media chose to make him a war hero albeit the facts.
At best he was a lousy pilot that got into Annapolis solely because his father and grandfather were admirals. The fact is that he was on the verge of being expelled until his father interceded and barely managed to graduate in the bottom of his class. He is a man without honor whose sole accomplishment was, after deserting his wife, to marry someone that could buy him a seat in congress.

Miranda exists to protect a 5th amendment right. They don't have to read you or anyone else the Miranda warning. The trade off is that they then cannot use anything incriminating in court against you. As long as they don't try to use incriminating statements against you in court they can hold off reading you Miranda and let you talk.

In a situation like this, with an unexploded truck bomb providing mounds of evidence, they don't necessarily need any self-incriminating statements or confessions. Given that he is believed to have trained overseas and possibly be connected in other ways to terrorist groups it's all the other information he can provide that becomes important. Not important to a case against him but to track down both others who may be threats, and get leads on other threats, that he may be aware of. Reading the Miranda warning could shut him up on not only on what he did but also what he knows regarding others.

Also, there is a public safety exception to Miranda. Given what he was trying to accomplish, and who he may have been connected to and the on going desire that other terrorists have for killing American, law enforcement might be able to legally reasonable delay reading him Miranda.

then Mirandized, then questioned some more. The information he gave has already lead to several arrests in Pakistan.

Hell, I don't know why the rightwingers insist that Mirandizing a suspect guarantees noncooperation. Anyone who has ever seen an American cop show knows what their Miranda rights are.

I knew he wouldn't win in 2007. Even then I could see what a moron he was and that he was going to be way out of touch with the voters. Plus, after 8 years of Rethug rule, I l knew the pendulum had to swing back to the Dems. Once the economy tanked, I knew it was over for him.

And just for bringing Mooselini on the national scene, he should be tried for treason and crimes against the country.

Mccain seems to be one, who serves not out of patriotism or a sense of duty but because it is something to add to their resume to make them look good. You can see the proof of this in the way he has treated fellow vets. and their families. Let me make one other point. These people who are so racist but say they 'support the troops', do not seem to understand a lot of those troops are hispanic and african american.
