In this case, like with the Duke "rape" case, an overzealous prosecutor was primarily concerned with scoring political points. In this case, the girl he had sex with was not the one who pressed charges and admitted that the sex act was totally consensual.

BULLETIN: A Georgia judge on Monday voided a 10-year sentence for Genarlow Wilson for having oral sex with a 15-year-old girl when he was 17 and instead gave him a 12-month misdemeanor sentence with credit for time he has already served.

The state is likely to appeal the ruling from Monroe County Superior Court Judge Thomas Wilson. Genarlow Wilson, who has already served more than 27 months, is expected to remain behind bars while that appeal proceeds.

IOW I hope he based it on something other than a non-retroactive law because if he simply based it on the new law, it wont, unfortunately, hold up in the higher state courts.

I don't know exactly what the change was, but this young man was 17 & his girlfriend was 15 when he was convicted. He's been in prison for 2 years already.

Wilson's original sentence, for aggravated child molestation, was widely criticized on the grounds it was grossly disproportionate to the crime, and state lawmakers later passed a law to close the loophole that led to the 10-year sentence.

A jury found the honor student guilty in 2005 of aggravated child molestation for having oral sex with a 15-year-old girl during a 2003 New Year's Eve party involving alcohol and marijuana. Although the sex act was consensual it was illegal under Georgia law.
