1. Yes. He doesn't have to testify. No one has to testify in their own trial. n/t |

4. If he's pardoned, he can't Claim the 5th in future GJ or trials |
|
Someone who's been pardoned can't claim that testimony would tend to incriminate himself, so he could be forced to testify against Cheney or Bush in any future trial.

8. Really. A pardon doesn't buy you the right to silence in other court cases. |
|
Someone who was pardoned can be compelled to testify against others. A Judge can throw a person with a pardon into jail permanently on contempt charges if he refuses to testify.

11. That's why pardons won't matter in this case. Fitz holds the trump card. |

3. Not if he wants to pursue the memory defense. |
|
Judge Reggie's already told him he must testify if he wants to preserve that line of defense.

The prosecution isn't calling him. His attorneys are. Why would someone refuse to testify if their attorney calls them?

|
I'm following this in the NYT. No cable. Atleast two people gave testimony in 04 to the GJ about conversations that Libby has now testified bto he either doesn't temember, or says didn't occur. What's up with that?
