Congress passes a Law defining torture and the US's ability to use it

Bush* signs the bill into Law with a signing statement of course but it basically becomes Law. Then by Executive Order he creates a new Law on torture and how the US can use it. Congress shrugs and no one utters a sound. The Constitution is pretty plain on what branch of government creates Law. Bush* has decided the Executive Branch is the one to do so now by decree. Am I the only one to see anything wrong with this?
