ACLU Applauds House Judiciary Action to Restore Habeas Corpus

Washington, DC – The American Civil Liberties Union is encouraged to see the House Judiciary Subcommittee on the Constitution, Civil Rights and Civil Liberties is meeting to mark up a vital bill to restore due process rights to detainees. H.R. 2826, introduced by Chairman Ike Skelton (D-MO) of the Armed Services Committee, will restore habeas corpus rights to those being detained by the United States government at the Guantanamo Bay Detention Facility.

September 17, 2007 · Congress revoked the right to habeas corpus for non-citizen enemy combatants last year. If reinstated, it would affect the detainees at Guantanamo Bay, some of whom have been held without charge for up to five years. Dahlia Lithwick, legal analyst with the online magazine Slate talks to Madeleine Brand about the Senate's possible vote to restore the detainees' right.

And Uphold Geneva Conventions

Reintroduce Bill Correcting Flawed Military Commissions Act

WASHINGTON (Monday, Feb. 12) -- Senator Chris Dodd (D-CT) today reintroduced his bill making important changes to the Military Commissions Act of 2006, which in its current form, does not provide a credible process for bringing suspected terrorists to justice. Sen. Dodd first introduced his bill last Congress and after working with human rights groups and experts in military law, Sen. Dodd was joined by Senators Robert Menendez (D-NJ), Patrick Leahy (D-VT) and Russ Feingold (D-WI) introducing the measure again in the 110th Congress.

The “Restoring the Constitution Act of 2007” restores Habeas Corpus rights, bars evidence gained through torture or coercion and reinstates U.S. adherence to the Geneva Conventions in order to protect the nation’s military personnel abroad.
