The Wisconsin Democrat who sits on the Judiciary Committee has issued a statement in which he concedes he has not yet made a decision on Mukasey:

He may be the best nominee we can get from this administration in this respect. But I am concerned about his views on executive power, and I am weighing whether his answers to questions in that area adequately demonstrate a commitment to the rule of law.

1. Didn't he do the same thing on Roberts?
Russ has some unexpected views about nominations. He thinks that a president should be given broad discretion in this area.

2. At this point, no attorney general is better than an authoritarian attorney general.
Just as the US would've been better off with no president vs. an authoritarian president the last seven years.

3. I'm all for rejecting Mukasey but there IS an AG
His name is Peter Keisler and he's even worse than Mukasey. He's the acting AG with all or the authority of an appointed AG.

6. Was Keisler second to Gonzales when Gonzo bailed?
I should've paid some more attention to his number 2 man instead of simply on number 1.

9. No, but he was at Justice.
he's close to bushco and is a prime member of the BFEE. He was rejected for a Federal Judgeship. He was at Justice in charge of the Civil Division. He led the gov't case against Habeas rights. He was one of bushco's lawyer in FL. He's up to his neck in the telecom wiretapping business, and represented them when he was in private practice. He co-founded the Federalist Society.

Bush originally named Paul Clemente as acting AG, then replaced him with the far worse Kiesler on the samae day he named Mukasey, an ugly bit of bait and switch to put pressure on the JC,
