Defense attorney uses sleepwalking as defense to rape allegations

I have read a few articles on this, but can't find the lawyers statements. I don't know if the college student was sleepwalking at the time, but whatever, this is just despicable. Not only does she hav to live with the trauma of being raped, she has to worry about contracting HIV too:(



"There is alarming news about the homeless man who is said to have raped a University of Cincinnati student early Thursday morning.

Dexter Ford was in court on Friday morning and according to his arrest report, we have learned the homeless man is HIV positive.

He made his first court appearance on his rape charge.

Police say the 52-year-old homeless man raped a UC student who has a history of sleep walking.

This all happened in a grassy area off the busy Taft Road exit of I-71.

People driving by say they saw a man on top of a woman and called 911.

One man even jumped out of his car and dragged Ford off the woman".

1. If he was truly sleepwalking he was unconscious and that means
unable of controlling what happened.. Because awake, he would never do something like that....This is true.... However, if the man was not homeless, perhaps he would have sought treatment, and this would not have happened... who knows.

it was the victim who was said to be sleepwalking, not the homeless guy.

3. Where does it say the defense is claiming the victim's sleepwalking is to blame?
I'm not seeing that in the article.
