Scalia is an asshole, but one with a brain and an intellect, no matter how warped. Thomas is a vengeful, angry, third-rate jurist who has been out for revenge on the world ever since he knew what "minority" meant.

3. True, he should be serving burgers at McDonald's... |
|
...he does not have the intellectual curiosity to be a judge...a total joke that he was even considered.
That said, I went with Scalia...Thomas is the dumbest, but Scalia causes the most damage...the architect of Gore v Bush got four other "morans" to think that ignoring 200 years of judicial precendence was a good idea.

Hell, at least Scalia had qualifications to be on the Court. As loathsome as he is. Thomas is exactly the same ideological stripe as Scalia...but has no business being on the Supreme Court.
Easily one of the worst justices in the history of the Supreme Court.

Look, I know Scalia is a jackass. But he's a smart, competent jackass. Sure, I'd rather a potted plant be on the SCOTUS than Scalia, but worse than Thomas? Thomas is a whiny, incompetent, ignorant, self-hating jackass.

Thomas, or the guy who tells Thomas what to do?
"Evil genius" is not part of being a good SC justice.

8. Choosing between Scalia and Thomas |

is sort of like choosing whether you would prefer dying being eaten by a shark or being cut up with a chain saw. To me they both equally suck.

21. if you ever listen to the tapes of the supreme court and hear scalia's voice |
|
Edited on Tue Nov-20-07 08:55 PM by RebelSansCause
you will know that it is the voice of the devil, the voice of pure evil. yet, reading his decisions, he makes everything sound so logical, so inexorable that he can nont possibly be wrong. but while sitting there, your brain is screaming in defiance because you it can not be true, you can not be agreeing with scalia. but thomas is a stooge. gawd this is hard. it depends on what you mean by "worst". most evil is scalia. least qualified is thomas.
i'm voting tony.
EDIT: spelling

23. So Many To Choose From . . . |
|
As a practicing trial lawyer, here is what I think.
I chose Thomas, because he's so bad in so many different ways. What passes for his "legal reasoning" resembles the amateurish interpretations of a self-taught layman. That, combined with his obvious agenda, is a legal train wreck. His appointment was classic Bush cynicism, nominating him to replace Thurgood Marshall. A fake Black and a fake lawyer to replace a monumental hero of the Civil Rights Movement.
Alito and Scalia are tied for third place. Scalia isn't stupid, he's just a nasty prick. Alito is a horrible judge. Scalia hates everybody, Alito just hates individuals, especially poor individuals.
Roberts may be the most dangerous, but I haven't seen enough of him to know for sure. Just because it looks like Herpes doesn't mean that it's a nasty disease that's going to be around forever, but it probably will be.
In an ordinary world, Kennedy would be just run of the mill terrible, but the others are so bad, he looks good by comparison. The same way one might feel kindly toward a migraine headache when one has an icepick in one's eye.
More challenging than picking out the bad justices would be finding a good one. The state of the court is so bad, that the stunningly mediocre justices look like shining beacons of jurisprudence. The Clinton nominees were pure products of triangulation, not meant to offend anybody. (The minute you become concerned with offending neo-cons, you are lost. Being offended is their trademark)
It's a sad state of affairs. I despair of ever seeing a Supreme Court that I would be proud of again in my lifetime, and I expect to live another 50 years.

26. Scalia brought pretzel logic to mind-numbing perfection |
|
when he wrote in the Gore v Bush decision that a full recount of Florida votes would be harmful to the President-elect. That was when I knew we were through the looking glass, and there's been no looking back.
