This has been all over the news here, so hopefully someone will step in.

To file for asylum an applicant must file within one year of arrival barring exigent individual circumstances or a significant change in circumstances in the emigre country. If her attorney missed a filing deadline, she ought to be able to demonstrate this. I don't understand her being detained as she doesn't seem a likely flight risk.
Curiously, we give temporary protected status to aliens from Nicaragua, El Salvador, Guatemala, and Honduras as well as Liberia, Somalia, and a few others, like Cuba (meaning we don't ordinarily deport them). Apparently it's OK to ship Zimbabweans back to Mugabe's Zimbabwe. A girl like this one would certainly be an asset to this country. Irrelevant under the Immigration Laws, however.
