Neighbor Testifies Teen Pulled Trigger While Smoking Pot

INDIO, Calif. -- A neighbor of a now-18-year-old Palm Desert resident accused of fatally shooting his best friend last year testified Tuesday that he witnessed the teen pull the trigger while they were smoking marijuana in the victim's bedroom with another friend.

Justin Silva took the stand in the trial of Isiah Alexander Mata, who is charged with murder in the death of 17-year-old Anthony Allan Newport just before midnight on April 21, 2007.

The shooting occurred in the victim's Palm Desert home in the 33700 block of Kelsey Court while his parents were out of town. Mata, who also was 17 at the time, was charged as an adult, but is being housed at Indio Juvenile Hall in lieu of $1 million bail.

Under questioning from Deputy District Attorney Charles Giancuzi, Silva testified that just before being shot, the victim was smoking pot on his bed. Mata, who was facing Newport in a chair, was holding a .25-caliber Lorcin semiautomatic gun, Silva said.
