Supreme Court: Come Back Next Week
The Supreme Court convened this morning before a sparse audience, which included the spouses of Justices Anthony Kennedy and Stephen Breyer. In the almost empty lawyers' section Alan Gura, the attorney who challenged D.C.'s gun ordinance in D.C. v. Heller, sat silently, awaiting the decision in his case. But he waited in vain. No Heller, no Exxon Shipping Co. v. Baker (Exxon Valdez punitive damages) no Kennedy v. Louisiana (death penalty for non-homicide rape.)
