3. I don't think the constitution says anything about it
I think the Republican party would have to pick someone, and while Palin is certainly the most popular choice among the base, I don't know that the Republican mucky-mucks would go for that. Romney got the most electoral votes, but Romney dropped out before Huckabee did, so I could argue for either of them.
