Couple sues McDonald's over nude photos on Web: Hubby left phone with wife's naked pictures at McDs
A Bella Vista couple found out the hard way that when a wife sends nude pictures of herself to her husband's cell phone, these pictures can end up on the Internet.

Phillip and Tina Sherman filed a lawsuit Friday against McDonald's Corp.; Mathews Management Co., which owns the McDonald's franchise on Sixth Street in Fayetteville; and Aaron Brummley, a manager of the restaurant.

The Shermans seek more than $ 3 million in damages after nude photos of Tina Sherman were posted on a Web site and she received threatening and harassing text and phone messages, according to the lawsuit.

Phillip Sherman on July 5 left his cell phone in the McDonald's restaurant. His wife had previously sent nude pictures of herself to this cell phone for his own use, according to the complaint.

5. Good luck to them, my guess is that it'll be thrown out
unless they can prove it was an employee of that franchise who found the phone and published the pictures.

My advice to everyone is to limit photography to the stuff you wouldn't mind seeing on the front page of your home town newspaper.

That's enough to have it taken to a jury, I would imagine, and let them decide whether it's plausible that someone other than an employee was responsible for send the texts/pics. Presumably the sends are timestamped, so that can be established without too much difficulty.

If she knew she left it at McDonalds, why didn't she go back to reclaim it?

This would be an easy scam. take picture. Post them on the Internet. toss phone in river. Sue wealthy business.

But I've seen worse attempts at scams.

Remember that lady a few years ago who found a finger in her Chili? I think it was Wendys. Turned out to be a scam

Heck they got someone to cutoff part of their finger for that scam. Thats alot crazier than a few snapshots of your naughty parts.

because they MIGHT get caught. Glad you cleared that up.

Now if you'll excuse me I have a prince emailing me from Nigeria who needs to get some good faith money from me. I was a little worried, but I'm sure once I remind him if he's doing anything dishonest it would be a crime the deal will go well.

According to US law, anyone posting a nude photo on the Interweb is considered a custodian of record and must comply with Title 18/2257 records-keeping requirements. In other words, each image must be accompanied with a photocopy of the subject's redacted ID, as well as an image of the subject posing with the ID. The couple should contact the site owner and let them know they are violating Federal law. That (and the threat to call the FEDs on their website) ought get the pics deleted - pronto.

21. This couple should have listened to their parents
when they were told to make sure they had clean underwear on because you never know when you'll be in an accident. Dirty underwear shouldn't be left anywhere else that could accidentally be exposed to public view either.

That aside, someone else may well have found the phone before it ended up in Brummley's hands and forwarded the photos before s/he turned it over. Phone records should tell.

If anyone these days does not know that nothing sent wireless is private, than s/he has to learn it the hard way.

Just as when people use computers at work for personal business and then are mad when the bosses use this to fire them, or something.

I hope that the judge will throw the suit out and make them pay defendant fees.
