It is called Congressional Privilege. And since the Constitution places the Legislative branch first - they take precedence!
Congressional Privilege isn't in the Constitution but neither is Executive Privilege.

By offering to allow Rove & Miers to testify, albeit without transcripts or oaths, the WH has abandoned EP. If Rove & Miers can speak without oaths or transcripts, then there can be no harm to the more formal arrangement.
