Justice report: Schlozman brought politics into hiring process

Bradley Schlozman, former U.S. attorney for the Western District of Missouri, considered political and ideological affiliations of prospective hires for sections he supervised within the Justice Department, according to a report by the agency’s Office of Inspector General.

Schlozman was the principal deputy assistant attorney general for the Civil Rights Division before becoming the U.S. attorney for the Western District of Missouri.

The Justice Department released a report Tuesday that said its investigation of Schlozman found that he favored applicants to the Civil Rights Division who had conservative political affiliations and demurred prospects “with civil rights or human rights experience whom he considered to be overly liberal.”

The chief of the Special Litigation Section told Justice Department investigators that Schlozman’s recommended hires to the department “generally lacked relevant experience,” to which Schlozman responded that “relevant experience was not always a plus,” according to the report.

Schlozman couldn’t be reached for comment Tuesday, but his attorney, William Jordan with Atlanta-based Alston & Bird LLP, said in a written statement that the report was “inaccurate, incomplete, biased, unsupported by law and contrary to the facts.”

Jordan said that Schlozman approached candidates who had a conservative view of the law, which is permissible, but said that didn’t equate to hiring individuals because they were Republicans or Democrats, which is illegal.

“He hired individuals from across the political and ideological spectrum based upon their academic records, respect for the rule of law and their ability to separate their personal views from the enforcement activities of the Civil Rights Division,” Jordan said in the statement.

The Justice Department’s Office of Inspector General report goes further to suggest that Schlozman continued his pattern of screening political affiliations while he served as the interim U.S. attorney for the Western District of Missouri.

Investigators unearthed an e-mail Schlozman sent Dec. 22, 2006, in which he sought authority to fill vacant assistant U.S. attorney positions within his department.

In the e-mail, Schlozman noted favorably an applicant’s work with President Bush’s election campaign and described another as “an obvious conservative of incredible intellect.”

In testimony before the Senate Judiciary Committee regarding his hiring practices while U.S. attorney, Schlozman denied using political affiliation as a litmus test for hiring decisions.

However, he did submit written testimony to Sen. Patrick Leahy, D-Vt., that said Schlozman once noted the political leanings of applicants to the Executive Office for United States Attorneys “in order to maximize the chances of obtaining authority to hire an additional (assistant U.S. attorney).”

He added that none of the individuals he referenced in the Dec. 22, 2006, e-mail was hired or even interviewed and that he had no direct role in the selection of candidates to be interviewed.

“The only thing I did was to formally make an offer to the candidate recommended by the hiring panel,” Schlozman wrote.

Also while U.S. attorney here, Schlozman sent this e-mail to a friend that reflected on his time with the Civil Rights Division compared with his role as U.S. attorney:

“It has been months since I felt the need to scream with a blood-curdling cry at some commie, partisan subordinate,” the e-mail said. “And I feel like the people I now work with are all complete professionals. What a weird change. Granted, these changes are nice in many respects, but *****slapping a bunch of (division) attorneys really did get the blood pumping and was even enjoyable once in a while. I think now it’s all Good Cop for folks there. I much preferred the role of Bad Cop ... But perhaps the Division will name an award for me or something. How about the Brad Schlozman Award for Most Effectively Breaking the Will of Liberal Partisan Bureaucrats. I would be happy to come back for the awards ceremony.”

The Justice Department’s Office of Inspector General referred the Schlozman matter to the U.S. attorney’s office for the District of Columbia to decide whether the information contained in the report constitutes a criminal matter.

Jordan said the U.S. attorney’s office declined to move forward with a criminal prosecution.

“The so-called ‘investigation’ was a Star Chamber-type inquiry from the start,” Jordan said. “Now, the fact that the OIG refuses to put the information that Mr. Schlozman provided to the government in its report, as well as the fact that he took and passed a polygraph exam with flying colors, shows how flawed, incomplete and biased its report truly is.”

Schlozman was U.S. attorney for the Western District of Missouri for about one year before being replaced in 2007. He is an of counsel attorney for Wichita law firm Hinkle Elkouri LLC.






I would not oppose the use of this instrument on Brad's package.
