The local police have not filed charges. Yet.

Question:

If the driver had a glass of wine, they will go to jail for 10 years for manslaughter or possibly longer if murder charges are filed.

If the driver had not had a glass of wine with dinner, there will be no charges filed.

This was a dangerous intersection and with a lot of traffic. visibility of a pedestrian would have been minimal due to headlights coming at you from six different directions. What is the right thing to do for the justice system?

What would you do if you were god?

1. Look at the driver's actual B.A. level and their driving history...
I'd have to have a different consequence if the person had a history of substance abuse and d.u.i..

I guess.

3. The system is ridiculous
I know of a case (sorry, no link) where a woman ended up in prison for years because she was (barely) legally drunk even though the person that she killed had fallen asleep at the wheel and his car had gone over the center divider and crashed head-on with her car.

i'd have pulled the plug on this experiment a LONG time ago, and started fresh with a new planet or a new species.
