"WASHINGTON - The U.S. Supreme Court is scheduled to hear oral arguments this morning on a reverse discrimination complaint by a group of white New Haven firefighters who claim they were denied promotion because the city illegally rejected their top promotional examination scores when black colleagues scored relatively poorly on the same test.

The Ricci case grows from a 2003 test administered by New Haven to screen candidates for promotion to the positions of fire lieutenants and captains. One hundred and eighteen people took the test; 56 passed. Nineteen of the top scorers were eligible for promotion to 15 open lieutenant and captain positions.
Of the 15 top scorers 14 were white and one was Hispanic. None of the 19 African-American firefighters who took the test qualified for promotion, the city said.
Interpreting the results, the city said that no minorities would have been eligible for lieutenant, and two Hispanics would have been eligible for captain. After a racially charged debate, the city threw out the test results because no blacks could be promoted. The city said the examination, designed by a private contractor, had a "disparate impact" on minorities and likely would have violated the 1964 Civil rights act."

this is interesting....doesn't seem fair to throw out test results simply based on race but it seems like there's a lot more to the story.
