The argument before the court is whether voters have the right to directly modify the constitution, and not whether gay marriage should be legalized. If the court says they don't, then Prop 8 will be overturned simply because it wasn't legally passed. The problem is that precedent already says that voters do have the right, so it's a longshot that this legal strategy is going to work. If it DOES, the ruling will immediately be challenged by voters rights groups across the state because it will undermine much of the initiative process as well (it could have ramifications far beyond Prop 8).
No matter how they rule, this fight will not end today.

As well as the additional states that have approved gay marriage since this case began.
